4 . If a specific means, method, technique, sequence or procedure of construction is <br /> indicated in or required by the Contract Documents, CONTRACTOR may furnish <br /> or utilize a substitute means, method, sequence, technique or procedure of <br /> construction acceptable to ENGINEER, if CONTRACTOR submits sufficient <br /> information to allow ENGINEER to determine that the substitute proposed is <br /> equivalent to that indicated or required by the Contract Documents . The procedure <br /> or review by ENGINEER will be similar to that provided in paragraph G. l as <br /> applied by ENGINEER (and as may be supplemented in the General <br /> Requirements) . <br /> 5 . ENGINEER will be allowed a reasonable time within which to evaluate each <br /> proposed substitution. ENGINEER will be the sole judge of acceptability and shall <br /> have the right to deny use of any proposed substitution. The CONTRACTOR shall <br /> not order, install or utilize any substitution without either an executed Change <br /> Order or ENGINEER's notation on the reviewed shop drawing. OWNER may <br /> require CONTRACTOR to furnish at CONTRACTOR'S expense a special <br /> manufacturer's performance guarantee(s) or other surety with respect to any <br /> substitute and an indemnification by the CONTRACTOR. ENGINEER will record <br /> time required by ENGINEER and ENGINEER's consultants in evaluating <br /> substitutions proposed by CONTRACTOR and in making changes in the Contract <br /> Documents occasioned thereby. Whether or not a proposed substitute is used, <br /> CONTRACTOR shall reimburse OWNER for the charges of ENGINEER and <br /> ENGINEER's consultants for evaluating each proposed substitute . <br /> 6 . Substitute materials or equipment may be proposed for acceptance in accordance <br /> with these paragraphs (F . 1 through F . 6). In the event that substitute materials or <br /> equipment are used and are less costly than the originally specified material or <br /> equipment, than the net difference in cost shall benefit the OWNER and <br /> CONTRACTOR in equal proportions . This cost difference shall not be reduced by <br /> any failure of the CONTRACTOR to base his bid on the named materials or <br /> equipment. <br /> D . PERMITS <br /> The OWNER has obtained the following authorizations : <br /> 1 . FDEP Joint Coastal Permit 0166929- 001 -JC <br /> USACE Permit No . 20001872 (IP-IS) <br /> 2 . The CONTRACTOR shall obtain and pay for all other required permits and licenses . <br /> The CONTRACTOR shall provide copies of these permits to the OWNER and <br /> ENGINEER and shall comply with all conditions contained in the permits at no extra <br /> cost to the OWNER. <br /> 3 . The CONTRACTOR shall be familiar with all permit requirements during <br /> construction and shall be responsible for complying with these requirements . The cost <br /> of this effort shall be included in the pay item with which the work is most closely <br /> associated . <br /> SUPPLEMENTARY CONDITIONS SC 3 <br />
