E. TESTS AND INSPECTIONS <br /> (This paragraph supplements paragraphs 13 . 4 and 14 . 5 of the GC .) With regard to <br /> paragraph 13 .4 of the GC, notice is hereby given that the OWNER may at any time during <br /> placement of material extract samples for independent testing at expense of OWNER. All <br /> other tests required in the Contract Document shall be provided by the CONTRACTOR. <br /> F . COMMENCEMENT AND COMPLETION OF WORK <br /> (This paragraph supplements paragraph 2 .4 of the GC . ) The CONTRACTOR will be <br /> required to commence work under this Contract within ten ( 10) calendar days after the <br /> date of receipt by him of the Notice-to-Proceed, and to complete the work by September <br /> 30, 2004. The time stated for completion shall include final clean up of all access locations <br /> and premises . <br /> G. INTERPRETATIONS OF PLANS AND CONTRACT DOCUMENTS <br /> (This paragraph supplements paragraph 6 . 4 of the GC . ) The CONTRACTOR shall verify all <br /> dimensions, quantities, locations, materials and details shown on the Plans, Supplementary <br /> Drawings, schedules or other data received from the ENGINEER, and shall notify him of all <br /> errors, omissions, conflicts and discrepancies found therein. Failure to discover or correct errors, <br /> conflicts or discrepancies shall not relieve the CONTRACTOR of full responsibility for <br /> unsatisfactory work, faulty construction, or improper operation resulting therefrom nor from <br /> rectifying such condition at his own expense . He will not be allowed to take advantage of any <br /> error or omissions , as full instructions will be furnished by the Architect or ENGINEER, should <br /> any error or omissions be discovered. All schedules are given for the convenience of the <br /> ENGINEER and CONTRACTOR and are not guaranteed to be complete . <br /> H . LIENS <br /> This project is a "Public Work " under Chapter 255 , Florida Statutes . No merchant's liens may be <br /> filed against the OWNER. Any claimant may apply to the OWNER for a copy of this Contract. <br /> The claimant shall have a right of action against the CONTRACTOR for the amount due him . <br /> Such action shall not involve the OWNER in any expense. Claims against the CONTRACTOR <br /> are subject to timely prior notice to the CONTRACTOR as specified in Florida Statutes Section <br /> 255 . 05 . The CONTRACTOR shall insert the following paragraph in all subcontracts hereunder: <br /> "Notice : Claims for labor, materials and supplies are not assessable against Indian River Count <br /> and are subject to proper prior notice to (CONTRACTOR'S Name) and to (CONTRACTOR <br /> Surety Company Name) pursuant to section 255 . 05 of the Florida Statutes This paragraph shall <br /> be inserted in every sub-subcontract hereunder. " <br /> I. PROTECTION OF PUBLIC <br /> 1 . The CONTRACTOR shall erect and maintain barricades and sufficient safeguards around <br /> all excavation, embankments or obstructions ; he shall place sufficient amber lights at or <br /> near the work, keep the same burning from sunset to sunrise, employ watchmen and strictly <br /> obey all laws and ordinances controlling or limiting those engaged on similar work. All <br /> maintenance of traffic work shall comply with Section 102 of the Florida Department of <br /> Transportation Standard Specifications for Road and Bridge Construction, 2002 edition . <br /> SUPPLEMENTARY CONDITIONS SC 4 <br />
