INDIAN RIVER COUNTY MITIGATION REEF PROJECT <br /> 0 TECHNICAL AND ENVIRONMENTAL SPECIFICATIONS <br /> 16 . PERMITS <br /> Copies of Permits are provided in Appendices A and B of these Technical and <br /> Environmental Specifications . The CONTRACTOR shall abide by all notes , conditions , <br /> and specifications indicated in the Plans , Permits , and Specifications . If the <br /> CONTRACTOR violates any condition of any permit or work is stopped by the COUNTY <br /> or any regulatory entity at the staging area or on the water for any reason , including for <br /> conditions such as excessive noise , any additional costs incurred by the <br /> CONTRACTOR, including fines or litigation , shall be the responsibility of CONTRACTOR <br /> at no additional cost to the COUNTY. Any delay caused by such lawful stoppage shall <br /> not excuse the CONTRACTOR from liability for liquidated damages should such <br /> stoppage cause or contribute to the CONTRACTOR being declared delinquent or in <br /> default of the Contract. <br /> 17 . MITIGATIVE REEF CONSTRUCTION — GENERAL <br /> 17 . 1 Site Markers and Construction Area . Natural reefs (defined as exposed and/or <br /> Ephemeral Hardbottom ) lie exposed or beneath a shallow sand layer within close <br /> proximity to the construction site . All known areas of exposed and/or Ephemeral <br /> Hardbottom habitat are shown on the construction plans . Widespread exposed and/or <br /> Ephemeral Hardbottom is known to occur both north and south of the Mitigation Area . In <br /> addition , in some areas drifting sand may have exposed rock/hardbottom/natural reef <br /> structure that is not identified on these or other drawings . It is the responsibility of the <br /> CONTRACTOR to determine locations of the exposed and/or Ephemeral or shallow <br /> hardbottom within his/her work and anchoring areas , and to avoid damage to these <br /> features . Exposed , buried and/or Ephemeral hardbottom may limit available anchoring <br /> methods . In order to protect the rock/hardbottom/natural reef structure , no anchoring or <br /> spudding shall take place on existing rock that is exposed and/or buried under shallow <br /> sand . The CONTRACTOR shall remain outside of any areas of exposed and/or <br /> Ephemeral Hardbottom . <br /> The CONTRACTOR shall place and maintain a minimum of seven buoys along the <br /> southern terminus of the Cable Avoidance Buffer Area/Northern Limit of the Work Area , <br /> at the coordinate locations identified on the Plans , for the duration of Mitigation Area <br /> construction . No material shall be placed within the Cable Avoidance Buffer Area or <br /> outside of the designated limits of the Mitigation Area as specified in the Plans . <br /> The Mitigation Area Coordinate Table , presented on the Plans , identifies designated <br /> corner location coordinates for the mitigation area transition areas associated with the <br /> reef placement. At a minimum , the CONTRACTOR shall establish temporary buoys at <br /> these locations during deployment using Differential Global Positioning System ( DGPS ) <br /> with sub-meter accuracy. <br /> 17 .2 Sand on Barge . Only clean sand , as designated by the COUNTY, shall be used to <br /> protect the deck of the barge during construction and under no circumstances shall the <br /> sand be allowed to enter the water. Additionally , the CONTRACTOR shall be <br /> TS-9 <br />
