INDIAN RIVER COUNTY MITIGATION REEF PROJECT <br /> TECHNICAL AND ENVIRONMENTAL SPECIFICATIONS <br /> by the COUNTY shall be brought to the attention of the CONTRACTOR and the <br /> appropriate regulatory agencies will be notified . The regulatory agency will <br /> determine the action to be taken and the COUNTY will notify the <br /> CONTRACTOR. Such actions may include discontinuing construction of the <br /> Project until the CONTRACTOR complies with the Environmental Protection <br /> Plan . The CONTRACTOR shall comply, and shall require all Subcontractors to <br /> comply, with all applicable Federal , State or local laws or regulations , Permits , <br /> easements and all elements of the Environmental Protection Plan . The <br /> CONTRACTOR shall be liable for any actions or delays resulting from any <br /> violation or non-compliance with the conditions of the Permits , easements and <br /> terms of this Contract attributable to their personnel and/or Subcontractors . <br /> 20 . DAILY REPORTS <br /> The CONTRACTOR shall prepare Daily Reports . The reports shall include all work <br /> activity, weather conditions , personnel , materials , and on-site equipment. The <br /> CONTRACTOR shall use a Daily Report Form that has been presented to and approved <br /> by the COUNTY in the Pre-Construction Meeting , The CONTRACTOR shall submit Daily <br /> Reports each day by 12 : 00 pm to the COUNTY in electronic format, with signed hard <br /> copies of the Daily Reports submitted to the COUNTY weekly. <br /> 21 . PAYMENT <br /> The Contract contains both Unit Price and Lump Sum items . As such , the intent of the <br /> Contract is to include all labor, materials , transportation equipment , fuel and all other <br /> items necessary to complete each item of work as detailed in the Plans and in these <br /> Technical and Environmental Specifications , in either the Unit Price or the Lump Sum <br /> bid for that item . All items incidental to or necessary for, completion of each bid item <br /> shall be included in the Unit Price or the Lump Sum price for that item . Payment for <br /> Mobilization / Demobilization is covered as a separate bid item under Section 22 . <br /> During the project, the CONTRACTOR shall prepare and submit to the COUNTY one <br /> original invoice and schedule of values worksheet for all work completed for one month <br /> periods to the extent of work days specified in the Contract. The CONTRACTOR may <br /> not submit more than one pay request per month . Unless otherwise specified , partial <br /> payments for Lump Sum items of work shall be based upon the percent of the items of <br /> work actually completed . The COUNTY shall pay the CONTRACTOR for all materials <br /> and labor according to the Unit Prices and Lump Sum prices indicated on the Bid <br /> Proposal . The COUNTY shall compute or verify all quantities of materials used in <br /> computing payments to the CONTRACTOR . Monthly progress payments shall be based <br /> on the tonnage of material placed at reef sites , according to the placement guidelines <br /> outlined in the plans and the Technical and Environmental Specifications , as estimated <br /> by the COUNTY. The COUNTY shall not compensate the CONTRACTOR for partial <br /> construction of a reef, i . e . , purchase and trucking of material to the staging site . Progress <br /> payments shall be subject to retainage as described in the General Conditions . <br /> TS- 17 <br />
