INDIAN RIVER COUNTY MITIGATION REEF PROJECT <br /> TECHNICAL AND ENVIRONMENTAL SPECIFICATIONS <br /> operation . The CONTRACTOR shall restore all areas disturbed as a result of <br /> construction , including , but not limited to, sidewalks , driveways , parking lots , fencing , <br /> stone revetment, bulkheads , vegetation and utilities . <br /> 28 .2 Sole Risk. The work , and everything pertaining thereto, shall be performed at the <br /> sole risk and cost of the CONTRACTOR from commencement until final payment by the <br /> COUNTY. Any specific references contained in these Contract Documents that the <br /> CONTRACTOR shall be responsible at its sole risk and cost for the work , or any part <br /> thereof, are not intended to be , nor shall they construed to be , an exclusive listing of the <br /> circumstances in which the CONTRACTOR bears the risk of loss , but rather they are <br /> intended only to be exemplary. <br /> 28 . 3 Loss or Damage . All loss or damage arising out of the nature of the work , or from <br /> the action of the elements , or from hurricanes , tropical storms , or from any unusual <br /> obstruction or difficulty, or any other natural or existing circumstances either known or <br /> unforeseen that may be encountered in the prosecution of the work , shall be sustained <br /> and borne by the CONTRACTOR at his/her own cost and expense at no additional cost <br /> to the COUNTY. <br /> 28 .4 No Claim . The CONTRACTOR shall have no claim against the COUNTY because <br /> of any damage or loss of the Work or CONTRACTOR' S personnel , materials , equipment <br /> or supplies , including loss or damage due to simultaneous work by others . <br /> 29 . STATUTES , LAWS AND REGULATIONS <br /> The CONTRACTOR hereby agrees and shall be solely responsible for ensuring that all <br /> project personnel of the CONTRACTOR and any Subcontractors make themselves fully <br /> aware of the requirements of any applicable ordinances , statutes , laws or regulations <br /> which may affect this Project or the CONTRACTOR'S/Subcontractor's work under this <br /> Project, including but not limited to safety regulations , minimum wage regulations , and <br /> others . The CONTRACTOR further agrees to be solely responsible for ensuring their <br /> personnel and Subcontractors are notified of any changes or modifications to any such <br /> applicable Permits , ordinances , laws , statutes , rules , or regulations . <br /> 30 . WEATHER CONDITIONS <br /> The Project area may be affected by tropical storms and hurricanes primarily from June <br /> through November, and by windy and/or rainy weather, including severe electrical <br /> storms , at any time during the year. The CONTRACTOR shall be responsible for <br /> obtaining information concerning rain , wind and wave conditions that could influence <br /> Project operations prior to submitting a bid . In addition to weather reports available on <br /> cable and local television and radio ( including NOAA weather radio ) , the following <br /> publications contain climatological and meteorological observations and data for the <br /> project area : <br /> 30 . 1 Local Climatological Data . The National Oceanic and Atmospheric Administration <br /> ( NOAA) , Asheville , NC publishes monthly summaries of local climatological data . <br /> TS-23 <br />
