Notice of Permit Modification <br /> Permittee: Indian River County <br /> Permit Modification No : 0166929=0054C <br /> Page 3 of 7 <br /> 13(k). Reports on the distribution and abundance of marine turtles in the vicinity of the <br /> nearshore hard bottom in the project area and on adjacent, undisturbed "control' sites shall <br /> also be provided prior to any beach filling activity, during all restoration work, and then for a <br /> minimum of two additional years. Monitoring of in-water sea turtle distributions shall <br /> include qty surveys conducted every six months (in the spring and fall). andimy <br /> -WSIAMffized by . Prior to issuance of a Notice to Proceed, the <br /> applicant shall submit a Monitoring Plan for In-water Sea Turtle Distribution and <br /> Abundance to the Department that has been pre-approved by PW9FWC. <br /> 13 (1). Reports on macroalgal distribution and abundance on nearshore hard bottom adjacent <br /> to the impact area, at the mitigation site, and on adjacent hard bottom communities that will <br /> not be impacted by the proposed nourishment ("control' communities) shall be provided <br /> prior to any nourishment activity and then for a minimum of two additional years. These <br /> reports shall include quotw4 semiannual quantitative assessments of percent cover by <br /> species, assessment of algal height per quadrat and per species, and amount of sediment <br /> within the quadrat prior to sampling. The amount, or biomass, of different algal species <br /> present at different times of the year should also be assessed. While long term monitoring <br /> should be done in replicate quadrats, additional plots should be identified (~ 10 cm X 10 cm) <br /> and all material, invertebrate, algae and sediment, scraped from the surface. This sample <br /> should then be sorted to the highest taxonomic level possible and dried to constant weight. <br /> After thorough review the staff has determined that the proposed alteration does not increase the <br /> potential for adverse impact on the coastal system, public beach access seaward of the mean high <br /> water line or nesting sea turtles and hatchlings and their habitat, and that the proposed alteration <br /> does not reduce the design adequacy of the project. Since the proposed modification is not expected <br /> to result in any adverse environmental impact or water quality degradation, the permit is hereby <br /> modified as stated above. By copy of this letter and the attached drawing, we are notifying all <br /> necessary parties of the modification. <br /> This letter of approval does not alter the October 23 , 2007 expiration date, other Specific or General <br /> Conditions, or monitoring requirements of the permit. This letter and the accompanying drawing <br /> must be attached to the original permit. <br /> This permit is hereby modified unless a sufficient petition for an administrative hearing is timely <br /> filed under sections 120.569 and 120. 57, Florida Statutes, as provided below. The procedures for <br /> petitioning for a hearing are set forth below. Mediation under Section 120. 573 , F.S . , is not available <br /> for this proceeding. <br />
