114 <br />FRIDAY, SEPTEMBER 20, 1957 <br />iE <br />The Board of County Commissioners of Indian River County met at the Courthouse in <br />Vero Beach, Florida in a special meeting at 9:00 o'clock A. M. Friday, September 20, 1957. <br />p� <br />Present were J. J. P. Hamilton, Chairman, D. B. McCullers, Jr.; Robert W. Graves and Donald <br />r <br />Macdonald. Absent was W. C. Graves, Jr. Also present were Sherman N. Smith, Jr., County <br />Rk <br />Attorney; Ed Schmucker, Superintendent of Roads and Katherine Morrison, Secretary. <br />The Chairman announced this meeting was called for the purpose of receiving bids i <br />on the Palecek property which is involved on the U. S. #1 right of way. Mr. Hamilton then z- <br />noted that Mr. and Mrs. Vern Whittier were present and requested that their matter be taken <br />up before the opening of the bids. <br />All members of the Board had received a memorandum from the County Attorney stating <br />he had received a call from Mr. J. Hardin Peterson of Lakeland who represents Mr. & Mrs. <br />Surrency. That Mr. Peterson had advised him that he intends to prepare and file suit as <br />soon as possible to let the Courts determine whether or not there is a public road through <br />the Surrency property. He requested that the County not take any action to take down the <br />gates or fences or do anything further in the matter, with the understanding that he will, <br />prior to October 20th, file a suit in order that the question can be decided by the Courts. <br />After some discussion with the Shittier's and upon Motion made by Commissioner Macdonald, <br />seconded by Commissioner Robert Graves, and carried, the Board decided to follow the re- <br />commendation of the County Attorney and grant this additional time requested by Mr. Peterson <br />on behalf of the Surrency's but no further extension of time to be granted. <br />VERO BEACH PRESS -JOURNAL <br />Published Weekly <br />Vero Beath, Indian River County, Florida <br />I , <br />STATE OF FLORIDA <br />COUNTY OF INDIAN RIVER: <br />Before the undersigned authority personally appeared J.
