5 <br />A memorandum from Sherman N. Smith, Jr., County Attorney was read with respect to <br />insurance coverage for the voting machines. It was noted that the Dalrymple Insurance Agency <br />was low with $400.00 per year on the 20 machines and the Rudy Hubbard Agency was high. After <br />some discussion in the matter and upon motion made by Commissioner Robert Graves, seconded by <br />Commissioner McCullers and unanimously carried the Board rejected both bids, deciding that the <br />III insurance per year was too high. <br />Upon Motion made by Commissioner Robert Graves, seconded by Commissioner Hamilton <br />and unanimously carried, the following resolution was adopted: <br />R E S O L U T I O N -- 16th Street R/W to State Road <br />Department from County <br />WHEREAS, the State Road Department of Florida has established location for that part <br />of 16th Street, Vero Beach, as Section 8860, Job 150, between S.R. 611 and Clemanns Avenue and <br />S. R. 5. and proposes.to construct and maintain the same as a part of its Secondary Road <br />program; and, Whereas, Indian River County is vested with all right of way required for saidl. <br />raod; <br />NOW, THEREFORE, the Board of County Commissioners of Indian River County does hereby <br />affirm that it is vested with all of the required right of wa y for said portion of said State <br />Road, to -wit: <br />The South 80 feet of the Southwest k of the Southeast k of Section 2, <br />excepting the Easterly 400 feet therefrom, the North 10 feet of Section <br />10 and the North 18 feet of, that part of Section 11, lying Westerly of <br />the Northerly extension of the Easterly Right of Way line of 14th Court <br />in Brae Burn Park, according to the Plat thereof, as recorded in Plat <br />Book 3, page 41, of the public records of Indian River County, Florida, <br />all in'Township 33 South, Range 39 East, and all of the rights and <br />interests of Indian River County into dedicated and used 16th Street <br />in Vero Beach as now exists, and portions of other dedicated streets <br />lying within the proposed Right of Way as shown on the Right of Way <br />Map of Section 8860-150, 16th Street in Vero Beach, as filed in the <br />Office of the Clerk of the Circuit Court, Indian River County, Florida. <br />and that said right of way is legally clear and has been physically cleared of all buildings, <br />fences and other improvements; that all utility poles, lines, cables, pipes and other facilities <br />have been removed or adjusted as required for construction of said project by the State Road <br />Department or such removal, and/or adjustments have been arranged for and will be effected <br />without delay to the State Road Department and/or its contractors; and the State Road Depart- <br />ment is hereby requested to proceed with the construction and maintenance of said portion of <br />said State Road; and Indian River County hereby agrees to save harmless the State Road Depart- <br />ment, its contractors, agents and employees, from all claims arising out of such construction <br />and maintenance of said road within the right of way aforesaid and to defend any and all <br />lawsuits to completion and satisfy any and all judgments therein made, at the County's expense. <br />NOW, THEREFORE, the Board of County Commissioners of Indian River County, does <br />hereby authorize the execution of a deed conveying the hereinabove described property to the <br />State of Florida for the use and benefit of the State Road Department. <br />Clerk Baker was instructed to record right of way Deed from County to State Road <br />Department and return said deed to the State Road Department at Fort Lauderdale. <br />0 <br />1 <br />1 <br />1 <br />n <br />L.J <br />
