u <br />1 <br />1 <br />1 <br />0 <br />1 <br />1 <br />0 <br />Upon Motion made by Commissioner McCullers, seconded by Commissioner Robert Graves, <br />and unanimously carried, the request made by Pasco Woods, Judge of the Small Claims Court at <br />the meeting of March 4th, asking the Commissioners to refund the costs in the crimianl case of <br />the State vs. Willie Shelton and in which said defendant was found not guilty, was granted. <br />The costs in this case to be refunded are in the amount of $21.85. <br />The secretary informed the Commissioners that Mr. Sheehan of the Veterans Adminis- <br />tration office had requested that the former County Service Officer, Elmer Harris, return the <br />files which he had removed from the office. The secretary stated she had called several times <br />;',and been unable to locate Mr. Harris and then had written him a letter but had heard nothing <br />from him to date. Upon Motion made by Commissioner Robert Graves seconded by Commissioner <br />McCullers and unanimously carried, the Board instructed the County Attorney to take the nec- <br />essary steps to obtain said files. <br />Two letters were read by the Chairman - one from the Disabled American Veterans Or- <br />gan <br />ization <br />r- <br />ganization and the other from the Veterans of ForeLgn Wars, John M. Mixon Post #3918 requesting <br />'I <br />,j an active and qualified Service Officer for Indian River County. Upon motion made by Comm- <br />jissioner Hamilton, seconded by Commissioner Robert Graves and unanimously carried, the Board <br />,t <br />:tabled this request until the two months trial period for the Veteran's Administration officer <br />have expired. <br />The Road and Bridge Superintendent stated he had been approached by the Mackle <br />Company with a request that if the county would lay and pack the marl base on the Roseland Road <br />a distance of about a mile and a half that they would put a 110 asphaltic top on same. He <br />further said he had requested the Mackle Company to put on a 1k" asphaltic top. Upon Motion <br />made by Commissioner McCullers, seconded by Commissioner Hamilton and unanimously carried, the <br />Board agrees to accept the proposition of the Mackle Company if they will meet the requirements <br />a of a lk" topping of Asphalt. <br />The following Resolution was introduced by Commissioner Graves, seconded by Comm - <br />issioner Hamilton and unanimously carried: <br />R E S O L U T I O N -- Condemnation for A -1-A <br />WHEREAS, the Board of County Commissioners acting for and on behalf of Indian River <br />,a <br />;County, Florida, have entered into an agreement with the State Road Department to obtain on <br />behalf of the County for the State of Florida for the use and benefit of the State Road Depart- <br />ment, all of the rights -of -ways, easements and lands required for the construction of Section <br />8807-102 State Road AlA in Indian River County, Florida; and <br />WHEREAS, said County has been unable by donation or purchase to acquire the remaining <br />parts thereof, NOW, THEREFORE: <br />BE IT RESOLVED by the Board of County Commissioners of Indian River County, Florida, <br />that Sherman N. Smith, Jr., the attorney for this Board, is herewith authorized and directed <br />to prepare and file in the Circuit Court of Indian River County, Florida, any and all docu- <br />ments required in order that all of said lands, rights -of -ways and easements required for the <br />truction of said road shall be"condemned in eminent domain proceedings and the title to <br />said lands vested in said State, including a Declaration of Taking as -authorized and directed <br />7 <br />31 <br />T-171 <br />
