0 <br />7 <br />C <br />1 <br />1 <br />0 <br />r �. <br />R E S O L U T I O N <br />WHEREAS, House Bill No. 2392 was enacted by.the Legislature of the State of Florida <br />in the 1959 regular session, which said Act changes the boundary line between Brevard County <br />and Indian River County, Florida, insofar as it pertains to that property lying between the <br />Indian River and the Atlantic Ocean in order that said boundary line between said counties <br />shall be the natural and logical location, that is, the centerline of the Sebastian Inlet; and <br />WHEREAS, the effectiveness of said Act is contingent upon its approval by the <br />electors of both counties at the special general election to be held on November 3, 1959; Now <br />therefore, <br />BE IT RESOLVED by the Board of County Commissioners of Indian River County, Florida, <br />that this Board does herewith approve and endorse the change of said boundary line as enacted <br />in said tet and does herewith urge the electors of this County to approve said Act; and <br />BE IT FURTHER RESOLVED that this Board does herewith announce that upon the change <br />of boundary line between said counties, it is the intention of this Board to cause State Road <br />to be paved from its present Northern terminus North of Wabasso, Florida, and continuing in a <br />general Northerly direction to the Sebastian Inlet and there by bridge over the Sebastian Inlet <br />to connect into the existing paved State Road AlA on the North side of said Inlet in order <br />that said State Road AlA may become a valuable arterial highway permitting traffic and commerce <br />to flow from the Northern part of Brevard County South through Brevard County and through <br />Indian River County to Fort Pierce, thus permitting the growth, development and expansion of <br />this entire island area to the benefit of both counties. <br />The County Attorney stated Mr. Fred Tuerk had tentatively agreed to the following <br />in return for the County's abandoning Old AIA right of way not presently used for,the new <br />right of way and abandoning the present Winter Beach Road from the new right of way to the <br />Beach and abandoning the old Joh's Island Road. <br />1st. He will give the County a 70 foot right of way from New AlA to the Ocean North <br />of the present Winter Beach Road on the Section line. <br />2nd. That if this right of way is ever used as a Beach it should be designated as <br />Ia public beach for the Winter Beach area. <br />3rd. Will convey to the County a 70 foot right of way through all the property he <br />owns which now is known as the Winter Beach Road to the present new AlA right of way. <br />Upbn Motion made by Commissioner Macdonald, seconded by Commissioner Hamilton and <br />carried, the Burd approves this tentative agreement as set forth in a memo by the County <br />Attorney and dated July 22, 1959. <br />Upon Motion made -by Commissioner McCullers, seconded by Commissioner Macdonald and <br />ly carried, the followigg:Resolutions were adopted: <br />
