i <br /> i <br /> If at any time Contractor's actual progress is inadequate to meet the requirements of the Contract, <br /> Owner may so notify Contractor who shall thereupon , at its expense , take such steps as may be necessaryto <br /> improve its progress to meet the approved schedule . If within a reasonable period as determined by Owner, i <br /> Owner determines that Contractor is not prosecuting its work with such diligence as will assure completion <br /> with the times scheduled, the Owner may declare a default of this Contract. <br /> i <br /> GC 31 INSPECTION . <br /> Engineer: The Owner may provide Engineering personnel for the observation of the work. The <br /> Owner, Engineer and their representatives shall at all times have access to the work whenever it is in <br /> preparation or progress, and the Contractor shall provide proper facilities for such access and for inspection . i <br /> If the specifications , the Engineer's instructions , applicable laws, ordinances, or any public authority require <br /> any work to be specially tested or approved , the Contractor shall give the Engineer timely notice of its <br /> readiness for observation and , if the observation is by another authority than the Engineer, of the date fixed for r <br /> such observation . If any work should be covered up prior to any quality inspection or test by Owner or <br /> Engineer, it must, if required by the Engineer, be uncovered for inspection and properly restored at the <br /> Contractor's expense. <br /> r <br /> GC 32 TESTING <br /> Unless otherwise provided in the Contract, drawings or specifications, shop testing of material or work <br /> shall be performed by the Contractor at its expense and in accordance with the technical specifications. <br /> Should tests in addition to those required by the specifications be desired by Owner, Contractorwill be advised <br /> in reasonable time to permit such additional testing at Owner's expense , unless additional tests are required <br /> due to Contractor's work or materials having failed any initial test. Contractor shall furnish samples as <br /> requested and shall provide reasonable assistance and cooperation necessary to permit tests to be performed ■ <br /> on materials or work in place, including reasonable stoppage of work during testing. <br /> GC 33 SUBSTITUTION . <br /> The naming of a specified product of specific manufacturers for equipment or materials under the <br /> various items of specifications or as shown on the plans shall be interpreted as establishing a minimum <br /> standard of quality and performance . It shall not be construed as eliminating the selection of other than the <br /> named equipment or materials equal to those specified, unless the materials are specifically designated as not i <br /> permitting substitution . <br /> Prior to proposing any substitute item , Contractor shall satisfy itself that the item proposed is equal or <br /> better to that specified , that such item will fit into the space allocated, that such item affords comparable ease i <br /> of operation , maintenance and service, that the appearance, longevity and suitability for the climate are <br /> comparable, that by reason of costs savings , reduced construction time or similar demonstrable benefit, the <br /> substitution of such item will be in Owner's interest and will in no way detrimentally impact the project i <br /> schedule. The burden of proof that such an item offered is equal in all respects to that specified shall be the <br /> Contractor's . Contractor shall submit drawings, samples, data and additional information as may be required <br /> by Owner. All requests for substitutions, with supporting information, shall be submitted by and at the expense <br /> of Contractor. At least 35 days shall be allowed for Owner's review. <br /> The Owner or its Engineer shall make the determination as to the acceptability of any substitution . <br /> Approval of a substitution shall not relieve Contractor from the responsibility for compliance with all i <br /> requirements of the Contractor. Contractor shall coordinate the change with all trades and bear the expense <br /> for any changes in other parts of the work caused by any substitution . <br /> Contractor may make only two requests for substitution in the same category and Contractor shall be i <br /> invoiced the expenses incurred by Owner for its design professionals in reviewing additional substitution <br /> requests , unless otherwise approved by Owner. <br /> i <br /> GC 34 CORRECTION OF DEFECTIVE MATERIALS OR WORKMANSHIP <br /> If any material , equipment or workmanship is determined by Owner, either during performance of the <br /> i <br /> 37 <br /> MOW 955'S AM <br />
