Conti act #SI34IAA <br /> 5 . Permits . Any work completed without proper permits shall not be considered in compliance with <br /> this Agreement , and shall not constitute work performed hereunder. Recipient acKnowledges its <br /> understanding that any work not properly permitted prior to implementation shall not be approved <br /> for payment by the District, and that Recipient may be fined per appropriate regu atory channels <br /> and/or may be required to remove said unauthorized construction . <br /> 6 . Legislative Requirements . The Florida Legislature requires recipients of funds granted through the <br /> Program to meet several specific conditions . The Recipient must provide the District with written <br /> assurance of its continued qualification under these requirements with submittal of its invoice or <br /> forfeit funding . Details concerning these requirements appear in subsections 373 . 1961 (2) (b) and (c) , <br /> Fla . Stat . <br /> 7 . Project Management. The parties shall designate project managers , who shall be esponsible for <br /> overall coordination , oversight, and management of the Work . District Project Manager. The District' s Project Manager shall have sole and complete <br /> responsibility to transmit instructions , receive information , and communicate District policies and <br /> decisions regarding all matters pertinent to performance of the Work . The District ' s Project <br /> Manager shall have the authority to approve minor deviations in the Work that do not affect the <br /> District cost share or the time for completion . <br /> 9 . Change in Project Manager . Either party to this Agreement may change its prof act manager by <br /> providing not less than three (3) working days prior written notice of the chane to the other <br /> Ply • <br /> 10 . Notices . All notices to each party shall be in writing and shall be either hand-d livered or sent <br /> via U . S . certified mail to the respective party ' s project manager at the names and addresses <br /> specified above . All notices shall be considered delivered upon receipt . Should either party <br /> change its address , written notice of the new address shall be sent to the other parties within five <br /> business days . Except as otherwise provided herein , notices may be sent via e-mail or fax , which <br /> shall be deemed delivered on the date transmitted and received . <br /> 11 . Status Report and Inspection. Recipient shall submit a brief final project report toDistrict' s Project <br /> Manager, summarizing completion of the project and describing the activities of the project. Prior to <br /> completion of the work, the District shall have the right to inspect the progress of the work during <br /> normal business hours and upon reasonable prior notice . <br /> 12 . Performance Monitoring. For as long as the Project is operational, the District shall have the right <br /> to inspect the operation of the Project during normal business hours upon reasonable prior notice . <br /> Recipient shall make available to the District any data that is requested pertaining to project <br /> performance . The purpose of this monitoring is to determine the long-term feasibility of the Project, <br /> and not to in any way affect the District' s cost share contribution to the Project . <br /> Page 2 of 8 <br />
