r <br /> between US 1 and Indian River Boulevard, (Road Project) and dedication of property from <br /> Harbor Trade Center which currently protrudes into 45th Street right of way; <br /> NOW, THERFORE , in consideration of the mutual terms, conditions , promises, <br /> covenants and premises hereinafter, the COUNTY and DEVELOPERS agree as ollows : <br /> 1 . The above recitals are affirmed as being true and correct and are thereby incorporated herein. <br /> 2 . CONSTRUCTION OF 45TH STREET IMPROVEMENTS . DEVELOPERS agree to <br /> share equally the cost in making the following improvements to 45th Street : an east bound <br /> right turn lane into Harbor Trade Center, an east bound left turn lane into Wahoo Retail, <br /> construction of a three lane section of 45th Street with center turn lane from station 11 +76 . 58 <br /> to station 22+ 83 . 00 . DEVELOPERS shall have fully engineered construction plans designed <br /> to Florida Department of Transportation "Green Book" standards for the Road Project (the <br /> " Construction Plans") and will provide these plans to the COUNTY and any necessary <br /> regulatory agencies, prior to construction for their review and approval . The DEVELOPERS <br /> shall select the architect, surveyor, engineering firm, and other professionals necessary to <br /> prepare the Construction Plans . The DEVELOPERS or their principals shall be solely <br /> responsible for obtaining all permits for construction of the Road Project. If the roadway is <br /> constructed prior to the installation of any water or sewer lines , the Construe on Plans shall <br /> be designed in such way that the roadway not be above any currently planned or anticipated <br /> water r sewer lines . Any changes to the permitted Construction Plans shall e approved by <br /> the COUNTY in writing. It is understood and agreed that commencement of the construction <br /> of the Road Project to occur within six (6) months from the date of this Agreement, with an <br /> anticipated completion date of six (6) months from the date of the commencement of <br /> construction. <br /> 3 . COST OF CONSTRUCTION OF THE ROAD PROJECT. DEVELOPERS shall mutually agree <br /> upon a road construction contractor who shall be authorized to do business in Indian River County, <br /> Florida for the construction of the Road Project according to the Construction Plans . The <br /> DEVELOPERS agree to each pay fifty percent (50%) of the total construction cost f the Road <br /> Project. <br /> 4 , RIGHT-OF-WAY ACQUISITION : Currently, the right-of-way of 45th Street direm.tly adjacent to <br /> the Harbor Trade Center Project Property is approximately 100 feet wide . Harbor T ade Centre LLC <br /> shall sell to COUNTY, as additional right-of--way along 45th Street, a 1 ,405 square ffiot strip of <br /> property as described in Exhibit "B " . The right-of--way shall be conveyed by deed at the request of <br /> 2 <br />
