DEVELOPER' S AGREEMENT BETWEEN <br /> INDIAN RIVER COUNTY, FLORIDA -.2 o� <br /> AND <br /> RINKER MATERIALS OF FLORIDA, INC . <br /> FOR <br /> IMPROVEMENTS TO 53RD STREET, <br /> DRAINAGE AND LANDSCAPING <br /> THIS DEVELOPER' S AGREEMENT ("Agreement") is entered into this 19th day of <br /> Jul y , 2005 , by and between INDIAN RIVER COUNTY, FLORIDA, a political <br /> subdivision of the State of Florida, with offices located at 1840 25th Street, Verd Beach, Florida <br /> 32960, hereinafter referred to as "County" and RINKER MATERIALS OF FLORIDA, INC. , a <br /> Florida corporation, with offices located at 1501 Belvedere Road, West Palm Beach, Florida <br /> 33406 , Attn : Don Beers, hereinafter referred to as "Developer" . <br /> WITNESSETH : <br /> WHEREAS , the Developer owns a parcel of property containing approximately 33 + acres <br /> located on what will be named 53rd Street, which is located immediately west of the FEC Railway <br /> right of way and which is legally described on Exhibit "A" attached hereto and inc rporated herein <br /> by reference (the "Developer' s Property") ; and <br /> WHEREAS , the Developer proposes to develop a portion of the Developer' s Property <br /> ("Phase I") along 53rd Street, (Indian River County Project Number SP-MA-04-06 -28/ 96020133 - <br /> 39577) which is legally described on Exhibit "B" attached hereto and incorporated herein by <br /> reference (the "Developer' s Project") ; and shown on the sketch attached hereto as Exhibit "C" and <br /> incorporated herein by reference with the balance of Developer' s Property being developed at a <br /> later date ("Phase I1") ; and <br /> WHEREAS , the County is planning to extend and pave 53rd Street as a 6 7 lane roadway <br /> from King ' s Highway to US Highway 1 and Developer' s Project, both Phase I and Phase 11 will <br /> impact the proposed roadway; and <br /> 1 <br />
