WHEREAS , the County and Developer share mutual concerns with respect to future <br /> roadway, and drainage requirements ; and <br /> WHEREAS , both the County and Developer can assist each other through dot joint effort that <br /> will provide for future roadway and drainage improvements . <br /> NOW, THEREFORE , in consideration of the mutual terms, condi ions , promises, <br /> covenants and premises hereinafter, the County and Developer agree as follows : <br /> 1 . The above recitals are affirmed as being true and correct and are thereby <br /> incorporated herein. <br /> 2 . The Developer agrees to grant the County a twenty (20) foot wide non- exclusive <br /> drainage easement located between the 53rd Street right-of-way and he North Relief <br /> Canal for the future drainage requirements for the portion of 53rd Str et to be located <br /> between the west right of way line of the FEC railway and the east right of way line <br /> of Lateral "H" Canal (the " 53rd Street Section") and drainage watershed area south of <br /> 53rd Street as current drainage patterns exist, per Exhibit "D", attached hereto . The <br /> non-exclusive easement shall include a portion of the existing ex avated lake on <br /> Developer ' s Property together with the right to convey stormwa er, the right to <br /> maintain drainage, and the right to maintain the existing outfall structure through the <br /> existing thirty six (36) inch pipe located on Developer ' s Property as shown on the <br /> sketch attached hereto as Exhibit "E" and incorporated herein by reference . <br /> 3 . The Parties agree that the Developer reserves the right to re-route or relocate the <br /> foregoing Drainage Easement at Developer' s expense . <br /> 4 . The Developer agrees to pay the cost of construction of two lanes of 53d Street along <br /> the project frontage, including earthwork (5000 cubic yards of f .11 , at a cost of <br /> $25 , 000 max . ), twelve ( 12) inch stabilized subgrade, ten ( 10) inch limerock base, <br /> two and one-half (2- 112 ) inches of asphalt, five- foot paved shoulders together with a <br /> 2 <br />
