BE IT FURTHER RESOLVED that in order to establish a new <br />area for the deposit of spoil and in order to provide pipeline access thereto, <br />that the State of Florida is herewith requested to grant an easement for the <br />new spoil area situated in Indian River County, Florida, described as follows, <br />to -wit: <br />PROPOSED SPOIL AREA: Being a parcel cf land on an island in <br />the Indian River South of Wabasso Road in Section 27, Township <br />31 South, Range 39 East, Indian River County, Florida, the <br />boundary of which is more particularly described by metes and <br />bounds as follows: <br />Commencing at a point 1910 feet South and 1428 feet West of the <br />Northeast corner of Section 27, Township 31 South, Range 39 <br />East, run South 21 degrees 47 minutes East a distance of 490 feet <br />to a concrete monument on the Westerly side of and approximately <br />97 feet West of the centerline of the Pine Island access road and <br />being the point of beginning. From the point of beginning run <br />South ''48 degrees 01 minutes East a distarce of 643 feet to a point <br />in the Indian River near the shore of the aforesaid island; thence <br />run South 42 degrees 17 minutes 17 seconds West a distance of <br />869.56 feet to a point in the Indian River; thence ru n North 48 <br />degrees 13 minutes 30 seconds West a distance of 581 feet to a <br />point in the Indian River and on the Southerly boundary of a pro - <br />posed park area; thence run North 38 degrees 13 minutes East a <br />distance of 101.55 feet to concrete monument on the shore of the <br />aforesaid island; thence continue North 38 degrees 13 minutes <br />East on the Southeasterly boundary of the aforesaid park area a <br />distance of 772 feet to the point of beginning. Containing 12.23 <br />acres' net. <br />and to grant a pipeline easement over, on and across the following described <br />property, situated in Indian River County, Florida, to -wit: <br />PROPOSED PIPELINE EASEMENT: Being an easen ent 40 feet in <br />width across a parcel of land' on an island in the Indian River <br />South of the Wabasso Road in Section 27, Township 31 South, <br />Range; 39 East, Indian River County, Florida, the boundary of <br />which' is more particularly described by metes and bounds as <br />follows: • <br />Beginning at a point 1910 feet' South and 1428 feet West of the <br />Northeast corner of Section 27, Township 31 South, ';Range 39 <br />East, said point lying in the river, and run South 21 degrees 47 <br />minutes East along the Easterly boundary of aforesaid easement <br />and also being the most Western leg of the Tuerk Tract 106-A, <br />a distance of 490 feet to the most Northerly corner Of a proposed <br />spoil area; thence run South 38 degrees 13 minutes West a dis- <br />tance of 46.19 feet; thence run North 21 degrees 47 sminutes West <br />on a line parallel to and 40 feet West of the aforesaid Easterly <br />boundary a distance of 575.04 feet to a point on the Northeasterly <br />boundary of a proposed park'area; thence run South ';54 degrees <br />38 minutes 25 seconds East on the aforesaid Northeasterly <br />boundary of a park area, a distance of 73.73 feet to the point of <br />beginning. Containing 0.49 acres, more or less; <br />to the United States of America in lieu of the area to be released from the <br />existing easement and in order to provide an area for the deposit of spoil <br />from the Intracoastal waterway; and, <br />
