26 . 08 MEDICAL LEAVE PAYMENT UPON SEPARATION FROM SERVICE <br /> A . Upon resignation or termination for cause of an employee from the <br /> County's services , all medical leave , current and accumulated , will be <br /> forfeited . Use of medical leave will not be approved or paid during the <br /> last two weeks of employment. <br /> B . Employees retiring in accordance with existing retirement plans or <br /> who have died will receive base pay for one- half of medical leave <br /> days accumulated up to a maximum of two hundred and forty hours . <br /> 26 . 09 DISABILITY LEAVE <br /> Disability leave with pay shall be provided by the County on the following <br /> basis : <br /> A. The disability resulted from an injury or an illness sustained directly in <br /> the performance of the employee's work , as provided in the State <br /> Workers' Compensation Act. <br /> B . If incapacitated for the employee's regular position , the employee may <br /> be given other duties with the Department for the period of <br /> recuperation , . provided the employee's medical condition permits . <br /> Unwillingness to accept such an assignment as directed by the EMS <br /> Chief will make the employee ineligible for disability leave during the <br /> time involved . <br /> 49 <br />
