The <br /> Emergency Services Director shall select from the top three ranked candidates the individual <br /> he believes, in his discretion, is most qualified for the position. <br /> 18 . 03 Each employee covered hereunder shall annually receive a written evaluation assessing his <br /> performance of the essential functions of the employee' s job. The appraisal form shall be <br /> developed by the Employer and the Union. <br /> 18 . 04 Newly hired employees shall serve an initial probationary period of one year. Newly hired <br /> probationary employees may be dismissed at any time at the discretion of the County and are <br /> not entitled to use the grievance/arbitration procedures relating to their discipline or <br /> discharge, and are not entitled to payments of sick leave or vacation leave at time of <br /> termination. <br /> 18 . 05 Employees who are promoted shall serve a promotion probationary period of one year. If an <br /> employee who is serving a probationary period incurred as a result of a promotion is found to <br /> be unqualified to perform the duties of the higher position, a good faith effort will be made to <br /> return the employee to the position and status held immediately prior to the promotion. Ifthe <br /> employee ' s former position is filled, the employee may be transferred to a vacant position for <br /> which the employee qualifies. If no vacancy exists for which the employee is qualified, the <br /> employee will be placed in a lay-off status with recall rights . <br /> ARTICLE 19 <br /> SHIFT EXCHANGE <br /> 19. 01 Employees may exchange shifts when the change does not interfere with the operations ofthe <br /> Fire Department, and when prior approval is granted at the discretion of the Fire Chief or his <br /> or her representative.
