36. 04 All personnel actions such as compensation, benefits, transfers, layoffs, return from layoffs, <br /> sponsored training, education, social and recreational programs, will be administered <br /> without regard to race, color, religion, sex or national origin. <br /> ARTICLE 37 <br /> DURATION AND RENEWAL <br /> 37 . 01 This agreement shall be in full force and effect from October 1 , 2004, to September 30, <br /> 2005 . This agreement shall continue in effect from year-to -year thereafter unless amended <br /> or terminated in the manner hereinafter provided. Either party desiring to amend or <br /> terminate this contract shall notify the other party in writing by February 1 of the year in <br /> which the contract expires. <br /> 37. 02 If the parties do not reach agreement by contract expiration, the existing terms and <br /> conditions shall continue until a new agreement is reached or the impasse is resolved. <br /> 37. 03 The Employer shall not reduce the staff levels as they existed upon the signing of this <br /> agreement, with the exception that staff levels may be reduced only as a result of attrition <br /> and the Employer will not institute layoffs in the event it limits its fire fighting activities. <br /> 37. 04 The Employer agrees that its operations, or any part thereof shall not be merged, assigned <br /> or otherwise transferred without first securing the agreement of the new employer to <br /> assume the Employer's obligations under this agreement. <br /> 9 t <br /> 44 <br />
