ARTICLE 18 <br />VACANCIES AND PROMOTIONS <br />18.01 The decision whether or not to fill a bargaining unit vacancy shall be within the sole <br />discretion of the Emergency Services Director. Should the Director decide to fill the <br />vacancy, the filling of the vacancy shall be in accordance with the District Personnel Rules <br />and Regulations, except as modified herein. <br />18.02 The Promotion Board shall be composed of the Assistant Chief, three (3) Battalion Chiefs, <br />three (3) Captains, and one (1) member of the Union or his designee who will be elected by <br />the bargaining unit. The Promotion Board shall rank the candidates, and forward the top <br />three ranked candidates to the Emergency Services Director, based upon the following <br />factors: job performance, examination scores, working out of classification, disciplinary <br />record, college degrees, educational courses, training, certification, and years of service. The <br />rankings shall be determined based upon a point system formulated in Article/Section 18.07. <br />The Emergency Services Director shall select from the top three candidates the individual he <br />believes, in his discretion, is most qualified for the position. <br />18.03 Each employee covered hereunder shall annually receive a written evaluation assessing his <br />performance of the essential functions of the employee's job. The appraisal form shall be <br />developed by the Employer and the Union. <br />18.04 Newly hired employees shall serve an initial probationary period of one year. Newly hired <br />probationary employees may be dismissed at any time at the discretion of the County and are <br />not entitled to use the grievance/arbitration procedures relating to their discipline or <br />discharge, and are not entitled to payments of sick leave or vacation leave at time of <br />termination. <br />18.05 Employees who are promoted shall serve a promotion trial period of six months. If an <br />employee who is serving a trial period incurred as a result of a promotion is found to be <br />unqualified to perform the duties of the higher position, a good faith effort will be made to <br />
