1 <br />BOOK / 1146 1150 <br />Mr. Charles Smith of Heath, Smith and Herring, appeared before <br />the Board and presented the following Petition, to -wit: <br />PETITION <br />The Board of County Commissioners <br />of Indian River County, Florida <br />Vero Beach, Florida <br />Gentlemen: <br />The undersigned, Chas. E. Smith, of Heath, Smith & Herring, <br />attorneys for Petitioners, A. T. LeFEVRE and ALICE K. LE FEVRE, his <br />wife, does herewith petition you to adopt a resolution closing, vacating and <br />abolishing the public roads, streets and rights-of-way located on the plat <br />of CARVER COLONY SUBDIVISION, #1, as recorded in Plat Book 4, page 87, <br />Indian River County public records, as it pertains to the following described <br />propery situated in Indian River County, Florida: <br />All of the right-of-way of 40th Avenue as shown <br />on the plat of Carver Colony Subdivision #1, as <br />recorded in Plat Book 4, page 87, Indian River <br />County public records, EXCEPT the west 30 feet <br />of said 40th Avenue; <br />and requests said Board to renounce and disclaim any rights of the said County <br />and the public in and to the above described public roads, streets and rights- <br />of-way as delineated on said recorded plat. <br />The Petitioners, A. T. LeFEVRE and Alice K. LeFEVRE, his <br />wife, are the owners of the property adjoining the above property sought to <br />be anandoned and the said property sought to be anandoned is not a State or <br />Federal Highway and the remaining 30 ft. width is sufficient for a road to <br />serve the property owners of said subdivision. <br />Sincerely, <br />(-/** ,E2 <br />Cnas.
