WHEREAS , pursuant to Florida Statutes Section 255 . 20 ( 1 ) (c ) 1 the competitive <br /> bidding requirements generally applicable to counties where a public construction work <br /> must be competitively awarded where the total construction project cost is more than <br /> $200 , 000 or, for electrical work more than $ 50 , 000 , are not applicable where a project is <br /> under taken to replace , reconstruct , or repair an existing facility damaged or destroyed by <br /> a sudden unexpected turn of events , such as an act of God , riot , fire , flood , accident or <br /> other urgent circumstances , and such damage or destruction creates an immediate danger <br /> to the public health or safety ; other loss to public or private property which requires <br /> emergency government action ; or an interruption of a essential government service ; and <br /> WHEREAS , Indian River County hereby finds that the declared emergency and <br /> damage and destruction caused by Hurricane Jeanne has caused Indian River County to <br /> •• sustain damage to an existing road and storm sewer located at Highlands Drive at the <br /> Indian River Farms Water Control District ( IRFWCD ) 13 - 10 Canal and such damage and <br /> destruction creates an immediate danger to the public health or safety ; other loss to public <br /> property which requires emergency government action ; and an interruption of the <br /> essential government service of providing a safe public county road system for the citizens <br /> of Indian River County , all as set forth in Florida Statutes Section 255 . 20 ( 1 ) ( c ) 1 ; and <br /> r. <br /> WHEREAS , the County has requested that the Contractor submit a proposal to <br /> perform the Work (as hereinafter defined ) on the Project ( as hereinafter defined ) on the <br /> terms and conditions set forth in this Agreement , and the Contractor has agreed to perform <br /> the Work ( as hereinafter defined ) on the Project ( as hereinafter defined ) on the terms and <br /> conditions set forth in this Agreement . <br /> NOW, THEREFORE , in accordance with the mutual covenants herein contained <br /> and other good and valuable consideration , the receipt and sufficiency of which are hereby <br /> "" acknowledged , this Emergency Contract is issued for the purposes set forth herein , and <br /> the parties agree as follows : <br /> 1 . BACKGROUND RECITALS . The Background Recitals are true and correct a , id form a <br /> material part of this Agreement . <br /> 2 , WORK , The Work under this Contract shall be as more fully set forth in Exhibit A <br /> attached to this Contract and made a part hereof by this reference in connection with the <br /> 4W County's repair of the storm sewer at Highland Drive IRFWCD B - 10 Canal ( " Project" ) . It <br /> is mutually agreed between the parties hereto that time is of the essence of this Contract . <br /> 2 . 1 Contract Time . Work shall be completed within 30 calendar days from date of <br /> Notice to Proceed . <br /> 2 . 2 . Extra or Additional Work . Without invalidating this Contract , the County may at any <br /> time , by written change order and without preliminary notice to the surety , order extra work <br /> within the general scope of this Contract ; request additional work ; or alter the work by <br /> �. addition or reduction , and the contract price will be adjusted accordingly . <br /> 2 <br />
