contract with OWNER : ( i) shall not have or acquire A. Reports and Drawings: The Supplementary <br /> any title to or ownership rights in any of the Drawings , Conditions identify: <br /> Specifications , or other documents (or copies of any <br /> thereof) prepared by or bearing the seal of 1 . those reports of explorations and <br /> ENGINEER or ENGINEER' s Consultant, including tests of subsurface conditions at or contiguous <br /> electronic media editions ; and (ii ) shall not reuse any to the Site that ENGINEER has used in <br /> of such Drawings, Specifications , other documents , or preparing the Contract Documents; and <br /> copies thereof on extensions of the Project or any <br /> other project without written consent of OWNER and 2 . those drawings of physical <br /> ENGINEER and specific written verification or conditions in or relating to existing surface or <br /> adaption by ENGINEER . This prohibition will survive subsurface structures at or contiguous to the <br /> final payment, completion , and acceptance of the Site (except Underground Facilities) that ENGI - <br /> Work, or termination or completion of the Contract. NEER has used in preparing the Contract <br /> Nothing herein shall preclude CONTRACTOR from Documents . <br /> retaining copies of the Contract Documents for record <br /> purposes . B . Limited Reliance by CONTRACTOR on <br /> Technical Data Authorized. CONTRACTOR may rely <br /> upon the general accuracy of the "technical data" <br /> ARTICLE 4 - AVAILABILITY OF LANDS ; contained in such reports and drawings , but such <br /> SUBSURFACE AND PHYSICAL CONDITIONS ; reports and drawings are not Contract Documents . <br /> REFERENCE POINTS Such "technical data" is identified in the Supplementa- <br /> ry Conditions. Except for such reliance on such <br /> "technical data , " CONTRACTOR may not rely upon or <br /> 4 . 01 Availability of Lands make any Claim against OWNER , ENGINEER, or any <br /> of ENGINEER's Consultants with respect to: <br /> A. OWNER shall furnish the Site . OWNER shall <br /> notify CONTRACTOR of any encumbrances or 1 . the completeness of such reports <br /> restrictions not of general application but specifically and drawings for CONTRACTOR's purposes , <br /> related to use of the Site with which CONTRACTOR including , but not limited to , any aspects of the <br /> must comply in performing the Work. OWNER will means , methods, techniques , sequences , and <br /> obtain in a timely manner and pay for easements for procedures of construction to be employed by <br /> permanent structures or permanent changes in CONTRACTOR , and safety precautions and <br /> existing facilities . If CONTRACTOR and OWNER are programs incident thereto; or <br /> unable to agree on entitlement to or on the amount or <br /> extent, if any, of any adjustment in the Contract Price 2 . other data , interpretations , opinions , <br /> or Contract Times , or both , as a result of any delay in and information contained in such reports or <br /> OWNER's furnishing the Site , CONTRACTOR may shown or indicated in such drawings ; or <br /> make a Claim therefor as provided in paragraph <br /> 10. 05 . 3 . any CONTRACTOR interpretation of <br /> or conclusion drawn from any "technical data" <br /> B . Upon reasonable written request, OWNER or any such other data , interpretations , <br /> shall furnish CONTRACTOR with a current statement opinions , or information . <br /> of record legal title and legal description of the lands <br /> upon which the Work is to be performed and 4 . 03 Differing Subsurface or Physical Conditions <br /> OWNER' s interest therein as necessary for giving <br /> notice of or filing a mechanic's or construction lien A. Notice: If CONTRACTOR believes that any <br /> against such lands in accordance with applicable subsurface or physical condition at or contiguous to <br /> Laws and Regulations. the Site that is uncovered or revealed either: <br /> C .
