12.03A and B Delete paragraphs 12.03.A and 12.03B of the General Conditions in their entirety and <br />replace with the following: <br />A. Where Contractor is delayed or prevented from completing any part of the Work within the <br />Contract Times due to delay beyond the control of Contractor, the Contract Times (or Milestones) will be <br />extended in an amount equal to the time lost due to such delay if (l) a Claim is made therefore as provided <br />in paragraph 12.02.A and (2) Contractor provides evidence that the delay impacted the critical path of the <br />Project. Delays beyond the control of Contractor shall include, but not be limited to, acts or neglect by <br />Owner, acts or neglect of utility owners or other contractors performing other work as contemplated by <br />Article 7, fires, floods, abnormal weather conditions or acts of God. The Contractor must request the <br />extension of time in writing and must provide the following information within the time periods stated <br />hereafter. Failure to submit such information and in compliance with the time requirements hereinafter <br />stated, shall constitute a waiver by the Contractor and a denial of the claim for extension of time: <br />1. Nature of the delay or change in the Work; <br />2. Dates of commencement and cessation of the delay or change in the Work; <br />3. Activities on the current progress schedule affected by the delay or change in the Work; <br />4. Identification and demonstration that the delay or change in Work affects the critical path; <br />5. Identification of the source of delay or change in the Work; <br />6. Anticipated extent of the delay or change in the Work; and <br />7. Recommended action to minimize the delay. <br />B. Contractor hereby affirms that the extension of time granted herein is the Contractor's sole and exclusive <br />remedy. Apart from extension of time, no payment or claim for damages shall be made to the Contractor as <br />compensation for damages for any delays or hindrances from any cause whatsoever in the progress of the <br />Work whether such delay is avoidable or unavoidable. <br />SC 12.03C Delete paragraph 12.03.0 of the General Conditions in its entirety. <br />SC 12.03D Delete paragraph 12.03D of the General Conditions in its entirety and replace with the <br />following: <br />In no event shall Owner, Engineer, or the Related Entities of either of them be liable to Contractor, any <br />Subcontractor, any Supplier, any other person or organization, or any surety for or employee or agent of <br />any of them, for any claim, cost, loss, or damages of any nature whatsoever arising out of or resulting from <br />delays. <br />ARTICLE 13 - TESTS AND INSPECTIONS; CORRECTION, REMOVAL OR ACCEPTANCE OF <br />DEFECTIVE WORK <br />SC 13.04C. Delete paragraph 13.04.0 of the General Conditions in its entirety and replace with the <br />following:. <br />If it is found that the uncovered Work is defective, Contractor shall pay all claims, costs, losses, and <br />damages (including but not limited to all fees and charges of engineers, architects, attorneys, and other <br />professionals and all court or arbitration or other dispute resolution costs) arising out of or relating to such <br />uncovering, exposure, observation, inspection, and testing, and of satisfactory replacement or <br />reconstruction (including but not limited to all costs of repair or replacement of work of others); and <br />Owner shall be entitled to an appropriate decrease in the Contract Price. <br />SC 13.04D.
