C&D DISPOSAL REGULATIONS AND MANAGEMENT <br /> 3 . 1 Florida C&D Debris Regulations <br /> r <br /> C&D debris is defined and regulated in Florida under Chapter 62- 701 of the Florida <br /> Administrative Code (F.A. C .) . This regulation provides facility design, permitting, operation, <br /> monitoring, closure and post-closure care requirements under Rule 62- 701 . 730, F.A . C . Rule <br /> 62-701 . 200(27), F .A. C. defines construction and demolition debris as <br /> r <br /> " . . . discarded materials generally considered to be not water soluble and non- <br /> hazardous in nature, including but not limited to steel, glass, brick, concrete, asphalt <br /> ,. material, pipe, gypsum wallboard, and lumber, from the construction or destruction of <br /> structure as part of a construction or demolition project or from the renovation of a <br /> structure, including such debris from construction of structures at a site remote from <br /> 01 the construction or demolition project site. The term includes rocks, soils, tree remains, <br /> and other vegetative matter which normally results from land clearing or land <br /> _ development operations for a construction project; clean cardboard, paper, plastic, <br /> wood, and metal scraps from a construction project; effective January 1, 1997, except <br /> as provided in Section 403. 707(12) 6), F. S. , unpainted, non-treated wood scraps from <br /> facilities manufacturing materials used for construction of structures or their <br /> components and unpainted, non-treated wood pallets provided the wood scraps and <br /> pallets are separated,from other solid waste where generated and the generator of such <br /> wood scraps or pallets implements reasonable practices of the generating industry to <br /> minimize the commingling of wood scraps or pallets with other solid waste; and de <br /> minimis amounts of other non-hazardous wastes that are generated at construction or <br /> r demolition projects, provided such amounts are consistent with best management <br /> practices of the construction and demolition industries. Mixing of construction and <br /> r demolition debris with other tvpes of solid waste will cause it to be classified as other <br /> than construction and demolition debris. . . " <br /> +� Facilities that dispose or process mixed C&D debris are required to (Rule 62-701 . 730, FAC) : <br /> • Obtain a permit from the FDEP ; which requires submission of a permit application <br /> and fees, including response(s) to FDEP requests for additional information (RAIs) <br /> and public hearings, if necessary; <br /> r <br /> • Construct and manage a groundwater quality monitoring system and report the <br /> results to FDEP that usually involves sampling, laboratory analytical testing and <br /> r reporting of groundwater quality on a semi-annual basis; <br /> FW996-03/11.70184 08- 10-2007.doc.doc 3- 1 2007-08- 10 <br /> r <br />
