4. OFFSTREET LOADING REGULATIONS: <br />The following spaces shall be provided for the uses indicated: <br />a. Every hospital, institution, hotel, commercial or industrial building, or <br />similar use, having a floor area in excess of ten thousand (10,000) square <br />feet requiring the receipt or distribution by vehicle of materials and mer- <br />chandise, shall have at least one permanently maintained offstreet loading <br />space for each ten thousand (10,000) square feet of gross floor area or frac- <br />tion thereof. <br />b. Retail operations, wholesale operations, and industrial operations with a <br />gross floor area of less than ten thousand (10,000) square feet, shall provide <br />sufficient space (not necessarily a full berth) so as not to hinder the free <br />movements of vehicles and pedestrians over a sidewalk, street, or alley. <br />c. Each space shall have direct access to an alley or street and shall have the <br />following minimum dime8sions: Length, twenty-five (25) feet; width, twelve <br />(12) feet; height, fourteen (14) feet. <br />5. PERMANENT RESERVATION: <br />Area reserved for offstreet parking or loading in accordance with the requirements <br />of this section shall not be reduced in area or changed to any other use unless the permitted <br />use which it serves is discontinued or modified, except where equivalent parking or loading <br />space is provided. <br />SECTION 18. GENERAL PROVISIONS: <br />1. Height Exception: Chimneys, towers, monument spires, radio towers, water tanks, <br />silos, windmills and similar structures may be erected above the height limits herein estab- <br />lished. <br />2. Clearance: Every part of a required yard shall be open from its lowest point to the <br />sky, unobstructed for the ordinary projection of sills, cornices, ornamental features and <br />eaves; provided, however, that none of the above shall extend into a minimum yard more <br />than 48 inches. <br />3. Yard Exceptions: In computing the depth of rear yards, the measurement of such <br />depth shall be made to the centerline of the alley, should an alley exist, at the rear of the <br />premises. <br />4. Above Ground Storage of Gasoline or Other Combustible Fluids: Where an above <br />ground storage of gasoline, petroleum oils, or similar inflammable fluids are permitted, <br />then as to any such facility for storage having a capacity in excess of 500 gallons, there <br />shall be erected and maintained a dyked area surrounding it, and the volume within the dyked <br />area shall be 1-1/4 tim3s the volume of the above ground storage tanks. The minimum width <br />of an earth dyke at the top shall be four (4) feet, side slope to an appropriate angle of repose, <br />and shall be capable of containing the liquid for a minimum of two days. The minimum <br />heights of dykes shall be three (3) feet. Other approved dykes constructed of concrete or <br />other materials shall be permitted; provided, however, that this does not permit the erec- <br />tion of any structure outside of the limits of the set back line of any zone. <br />5. Non -conforming Uses: The lawful use of a building or premises existing at the time <br />of the adoption of this Resolution shall not be affected by this Resolution although such use <br />does not conform to the provisions of this Resolution and such may be extended throughout <br />the building; provided no structural alterations are made therein, but no such use shall be <br />extended to occupy any land outside such building and no such non -conforming use shall be <br />otherwise enlarged or increased. If such non -conforming use is discontinued for a continu- <br />ous period of not less than ninety days, every future use 'of such building or premises shall <br />be in conformance with the provisions of this Resolution. No non -conforming use that has <br />been destroyed by more than fifty percent can be restored for such continued non -conforming <br />use.
