FEB 101965 <br />BOOK 9 PACE 144 <br />the point of normal or routine maintenance, provided however, that, in the event of fire or <br />natural disaster, that if the non -conforming section is less than 50% destroyed, it may be <br />rebuilt and restored to its former condition as to structure and appearance. <br />6. Deed Covenants:' It is not intended by this Resolution to interfere with or abrogate or <br />annul any easements, covenants or other agreements between parties; provided, however, <br />that where this Resolution imposes a greater restriction upon the uses of building and lands <br />or requires larger open spaces than is imposed or required by other resolutions or by other <br />easements, covenants or agreements, then the provisions of this Resolution shall govern. <br />7. Houseboats: No houseboats, barge or boat shall be fastened to any dock, anchored <br />or attached to any land or remain in any of the waterways where the same is used for any <br />amusement or dwelling place. <br />8. Board of Adjustment: The Indian River County Beare of Adjustment is herewith <br />authorized to make special exceptions to the terms of this Resolution in harmony with the <br />general purpose and intent hereof and in appropriate cases the subject to appropriate condi- <br />tions and safeguards in accordance with the provisions' of said Act and in accordance with <br />rules adopted by said Board of Adjustment in accordance with said Act and this Resolution. <br />9. In the event of the recording of any proposed street or road in the bffice of the Clerk <br />of the Circuit Court of Indian River County, Florida, or in the event of the designation or <br />establishment by this Board of any proposed public street or road, the same shall thereupon <br />immediately become the same as if such public street or road existed for the purpose of <br />determining setbacks under the terms of this Resolution. <br />10. No building shall be erected, constructed, reconstructed or structurally altered <br />unless and until a building permit has been issued under.the authority of this Resolution <br />except as otherwise specifically provided by this Resolution. The fees to be paid to the <br />County for such building permits shall be the fees now or hereafter established by Resolution <br />of this Board and such fees as so established shall be paid prior to the issuance of any permit. <br />11. Interpretation: In interpreting and applying the provisions of this Resolution, the <br />requirements hereof shall be held to be the minimum requirements for the promotion of the <br />public health, safety, morals and general welfare of the County. If because of error or <br />omission in the Zoning Atlas any property in the territory of Indian River County, Florida, <br />lying outside the corporate limits of any municipality, is not shown as being in a zoning dis- <br />trict, the classification of such property shall be R 1 A, Country Home District. <br />12. Obstructions to Vision: No obstructions to vision shall be planted or erected with- <br />in twenty (20) feet of the right-of-way corner of any road or street intersection. <br />13. Changes and Amendments: This Board may from time to time on its own motion <br />or on petition of any person, amend, supplement, change, modify or repeal by resolution <br />pursuant to the authority and in the manner provided by said Act this Resolution or the <br />boundaries or districts or regulations herein established. <br />14. Validity; Should any section, clause, word or part of this Resolution be declared <br />invalid, the same shall not affect the validity of the remainder, it being the intent and pur- <br />pose of this Board to adopt this resolution and the parts thereof separately and severally. <br />All resolutions or parts of resolutions in conflict herewith or inconsistent with the provisions. <br />of this Resolution are hereby rescinded. <br />15. Any person desiring a change or amendment to the Zoning Resolution or Zoning <br />Map shall submit the same in writing to the County Engineer described by legal description <br />and by street address, where possible, the property to be affected by the proposed change, <br />setting forth the present zoning applicable thereto and specifying the district, zone or use <br />requested by the applicant. There shall be at said time paid to the County Engineer for the <br />account of the County the sum of $50.00 for each such requested change; providing, however, <br />that as many lots or parcels of property as the applicant may desire may be included in .any <br />single petition provided the same is one contiguous area. The County Engineer shall then <br />transmit the application to the Zoning Commission for tentative consideration at its next <br />meeting. Should the Zoning Commission tentatively approve the petition, it shall report <br />its tentative approval to the County Commissioners and should, the County Commissioners <br />-15- <br />
