41 .2 Accident Prevention Plan. The CONTRACTOR is required to submit to the <br /> COUNTY an Accident Prevention Plan ten ( 10) days after the Notice of Award and <br /> prior to the pre-construction meeting. The Accident Prevention Plan must be in <br /> accordance with all Federal safety standards as specified in EM 395- 1 - 1 , dated <br /> September 1996 , entitled "Safety and Health Requirements Manual." Submission of <br /> the Plan does not constitute an endorsement on the part of the COUNTY or <br /> ENGINEER of the CONTRACTOR' S Accident Prevention Plan . The Plan is <br /> intended to provide a method by which the CONTRACTOR demonstrates an <br /> awareness of Federal safety standards. <br /> 41 .3 OSHA Standards. The CONTRACTOR shall review the Corps of Engineers <br /> Manual , General Safety Requirements EM 385- 1 - 1 , dated September 1996 and the <br /> latest Occupational Safety and Hazard Agency (OSHA) standards and become fully <br /> knowledgeable of the personal protective equipment that must be provided workers <br /> and shall be familiar with the safety standards applicable to the prevention of <br /> accidents during the construction of this project and shall comply with all applicable <br /> provisions. <br /> 41 .4 Trench Safety Act <br /> 41 .4. 1 The provisions of the Occupational Safety and Health Administration's excavation <br /> safety standards, 29 C.F.R. s. 1926.650 Subpart P are incorporated as the state standard. <br /> The Department of Labor and Employment Security may, by rule, adopt updated or <br /> revised versions of those standards, provided that the updated or revised versions are <br /> consistent with the intent expressed in this act and Section 553 .60 et seq., Florida Statutes, <br /> and are not otherwise inconsistent with state law. Any rule adopted as provided in this <br /> section shall be complied with upon its effective date. <br /> 41 .4 .2 On all parts of the work that require trench excavation in which such excavation will <br /> exceed a depth of 4 feet, the CONTRACTOR shall submit to the COUNTY a reference to <br /> the trench safety standards that will be in effect during the period of construction of the <br /> project and written assurance by the CONTRACTOR performing the trench evacuation <br /> that such CONTRACTOR will comply with the applicable trench safety standards. <br /> TECHNICAL AND ENVIRONMENTAL SPECIFICATIONS Rev October 5 , 2007 TS-41 <br />
