F . Non -Compliance : Should the Owner or Engineer determine that erosion control <br /> within the project is not being maintained in accordance with the FDOT indexes <br /> and specifications , the contractor shall have until the end of the working day in <br /> which notification is given to take corrective action . Should the contractor fail to <br /> make such modification the Owner shall have the option to fine the contractor $400 <br /> per day until remedied . <br /> G . The OWNER may terminate this Contract if the CONTRACTOR fails to comply <br /> with this Section . Alternatively , the OWNER may halt the CONTRACTOR' s <br /> operations until the CONTRACTOR is in full compliance with this Section . If the <br /> OWNER halts the CONTRACTOR ' s work as a result of its failure to comply with <br /> this Section , the Construction Contract time clock will continue to run . <br /> K In addition to these Specifications , comply with Chapter 4 , " Best Management <br /> Practices for Erosion and Sedimentation Control " of the Florida Erosion and <br /> Sediment Control Inspector' s Manual , included herein in Appendix " B . " If there is a <br /> conflict between the referenced Chapter 4 and these Specifications , the more <br /> stringent requirement shall prevail . <br /> I . Compensation : All payment for the above items shall be made under Item <br /> Item No , 104- 1 Erosion & Water Pollution Control — Lump Sum <br /> SECTION 00110 CLEARING AND GRUBBING <br /> A . Payment for Clearing and Grubbing shall include compensation for: the removal <br /> and disposal of asphaltic concrete and existing concrete pavement , concrete , <br /> sidewalks , curbing , abandoned utilities ( including pipes , cables , conduit and <br /> structures) , existing walls , riprap , various types of fences , base material , trimming <br /> of trees and shrubs , drainage structures , pipe , backfilling the removal excavations , <br /> plus all other items necessary to be removed to construct the project . All non - <br /> salvageable materials removed shall remain property of the Contractor unless <br /> otherwise directed by the Engineer or Owner (See Article SC-W) . All unwanted <br /> materials shall be removed and suitably disposed of by the Contractor outside the <br /> project limits (see Article SC-W) . Any salvage value received from the removed <br /> materials shall be reflected in the Contractor's proposal . <br /> B . Clear and grub within the entire limits of the right-of-way except in specific areas <br /> designated by the Engineer to remain for aesthetic purposes . <br /> C . Existing and temporary asphaltic pavement and excess subsoil shall be disposed <br /> of outside the project by the Contractor, at a location and in a manner approved by <br /> the Engineer. <br /> D . Removal of existing pavement includes all removal and disposal of the asphalt <br /> within the limit shown on the plans . <br /> E .
