SECTION 01009 <br /> SPECIAL PROVISIONS <br /> 1 . 1 GENERAL <br /> A . Visits to the construction site may be made by representatives of permitting or <br /> governing bodies . Submit details of all instructions from the above to the <br /> ENGINEER immediately . The OWNER will not accept the Work until final <br /> acceptance has been received from the various Regulatory Agencies having <br /> jurisdiction . <br /> B . Furnish sufficient labor , construction equipment and materials , and work such <br /> hours , including night shifts and overtime operations , as may be necessary to <br /> insure the prosecution of the work in accordance with the approved progress <br /> schedule . If in the opinion of the ENGINEER and ENGINEER' s CONSULTANT , <br /> the CONTRACTOR falls behind the progress schedule , take such steps as may <br /> be necessary to improve progress , all without additional cost to the OWNER . <br /> The ENGINEER and ENGINEER' s CONSULTANT shall be compensated for <br /> his overtime services in accordance with the Supplementary Conditions . <br /> Failure to comply with the requirements of the ENGINEER and ENGINEER' s <br /> CONSULTANT under this provision shall be grounds for determination by the <br /> ENGINEER and ENGINEER' s CONSULTANT that the CONTRACTOR is not <br /> prosecuting the work with such diligence as will insure completion within the time <br /> specified . Upon such determination , the ENGINEER and ENGINEER' s <br /> CONSULTANT may recommend to the OWNER to seek such legal remedy as is <br /> deemed necessary to protect the OWNER' s interest . <br /> C . All salvageable material and equipment for which specific use , relocation , or <br /> other disposal is not specifically noted shall remain the property of the OWNER <br /> and shall be delivered at the CONTRACTOR' s expense to the OWNER at the <br /> Indian River County Road and Bridge Facility at 4550 41st Street , Vero Beach , at <br /> the CONTRACTOR' s expense . All material and equipment not in salvageable <br /> condition , as determined by the ENGINEER and ENGINEER' s CONSULTANT <br /> shall be disposed of by the CONTRACTOR , at the CONTRACTOR's expense . <br /> All excess excavated soils shall remain the property of the OWNER and shall be <br /> disposed of as directed by the ENGINEER and approved by the OWNER . <br /> D . Requirements of Permits or Grants : In addition to these Specifications , all Work <br /> shall comply with the requirements of local permitting agencies , St . Johns River <br /> Water Management District , the U . S . Army Corps of Engineers , and all other <br /> state or federal agencies' permit or grant requirements . If there is a conflict <br /> between the Specifications and any permit or grant requirement , then the most <br /> stringent specification or requirement shall govern .
