requirements , or fails to comply with the technical specifications , or fails to perform the Work in such a way that the completed Work will conform to the Contract Documents , OWNER may order CONTRACTOR to stop the Work, or any portion thereof, until the cause for such order has been eliminated ; however, this right of OWNER to stop the Work shall not give rise to any duty on the part of OWNER to exercise this right for the benefit of CONTRACTOR, any Subcontractor, any Supplier, any other individual or entity, or any surety for, or employee or agent of any of them. 14.02 Progress Payments SC- 14. 02 . B . 5 . Delete paragraph GC44. 02. B. 5. d in its entirety and insert the following paragraph in its place. d . ENGINEER has actual knowledge of the occurrence of any of the events enumerated in paragraph 15 . 02 .A; or SCA4. 02 . B . 5 . Add the following sentences at the end of paragraph GC- 14. 02. 6. 5: e. OWNER has been required to pay ENGINEER additional compensation because of CONTRACTOR delays or rejection of defective Work; or f. OWNER has been required to pay an independent testing laboratory for subsequent inspections , tests , or approvals taken after initial failing inspections , tests , or approvals . SC- 14. 02 . C . 1 . Delete paragraph GC44. 02. C. 1 in its entirety and insert the following paragraph in its place. Co Payment Becomes Due 1 . Payment shall be made by OWNER to CONTRACTOR according to the Local Government Prompt Payment Act. F. S . 218 . 70 et. seq . SCA4 . 04A. After the third sentence in paragraph GC44. 04A of the General Conditions, delete the remainder of paragraph 14. 04A in its entirety and replace with the following: " if Engineer considers the Work substantially complete , Engineer will prepare and deliver to Owner a tentative certificate of Substantial Completion that shall fix the date of Substantial Completion . In accordance with the provisions of Florida Statutes section 208 . 735 (7) (a)(2005) , upon receipt of the tentative certificate of Substantial Completion from Engineer, the Owner, the Engineer, and the Contractor shall conduct a walk-through inspection of the Project to document a list of any items required to render the Work on the Project complete , satisfactory, and acceptable under this Agreement ( herein the "Statutory List") . The Statutory List shall be reduced to writing and circulated among the Owner, the Engineer, and the Contractor by the Owner or the Engineer within 30 calendar days after substantial completion .
