decisions , etc. <br /> ( 2 ) Maintain a roster of subcontractors will name and contact telephone numbers for key <br /> personnel . <br /> ( 3 ) Provide a safety program for the project and conduct a safety meeting prior to <br /> commencing work . <br /> f) Any disputes which may arise in this connection between the Contractor and any <br /> subcontractor must be settled between the parties concerned . The Owner will not undertake nor <br /> be in any way responsible for the settlement of such disputes . <br /> GC 4 ENGINEER' S STATUS . <br /> a ) The Engineer will provide observation of the Contractor' s activities and progress of the <br /> work . The Engineer will make complete and thorough inspections of all construction , draft change orders , <br /> and verify and certify partial and/or final payments due to the Contractor. The Engineer may , during the <br /> life of the Contract issue additional instructions , by means of drawings , minor change orders or otherwise , <br /> necessary to illustrate changes in the work . <br /> b) The Engineer shall have authority to stop the work whenever such stoppage may be <br /> necessary to insure the proper execution of the Contract or to protect the public and/or property . He shall <br /> also have authority to reject all work and materials which do not conform to the Contract and to decide <br /> questions which arise in the execution of the work . <br /> C) The Engineer will make decisions in writing on all claims of the Contractor, and on all <br /> other matters relating to the execution and progress of the work or the interpretation of the Contract <br /> documents . All such decisions of the Engineer shall be final . <br /> GC 5 DESIGN DRAWINGS AND SPECIFICATIONS . <br /> a ) The Owner through the Engineer, or the Engineer as the Owner' s representative , shall <br /> furnish plans and specifications which completely represent the requirements of the work as far as <br /> practical to be performed under the Documents and shall be true developments thereof. The Owner will <br /> be responsible for the adequacy and sufficiency of the plans and specifications . The Owner or Engineer <br /> will provide the Contractor with copies of all drawings and specifications , not to exceed four (4 ) complete <br /> sets , for the execution of the work. <br /> b) The specifications and the drawings accompanying them are intended to describe and <br /> provide for a finished piece of work; they are intended to be complementary and what is called for by <br /> either shall be as binding as if called for by both . The Contractor understands that the work shall be <br /> complete in every detail , notwithstanding every item necessarily involved is not particularly mentioned , <br /> and the Contractor shall be held to provide all labor and material necessary for the completion of the <br /> indicated work . <br /> C) The Contractor shall , immediately upon receipt of the drawings , check all drawings <br /> furnished and shall promptly notify Owner of any illegibility , errors , omission , defect or discrepancies <br /> discovered in such drawings and shall comment as appropriate upon construction feasibility and <br /> practicality . The Contractor shall perform work only in accordance with the permitted drawings and any <br /> subsequent revisions thereto . <br /> d ) If the permitted drawings change the scope of the work , the Contractor shall notify the <br /> owner and Engineer within seven ( 7 ) days of receipt of the permitted drawings and such notification shall <br /> contain a written description of the change and its impact on the cost and schedule , if any . Failure to <br /> provide such notice within seven days shall be a complete waiver by the Contractor of all additional cost <br /> and time and Contractor shall perform the work at his expense and complete the work according to <br /> schedule and in no event shall Contractor recover delay or consequential damages . <br /> 31 <br /> 12/1(2009 3:45:46 PM <br />
