ORDINANCE 2005-030 <br />thirty-two (32) inches wide and spaced no more than two -hundred (200) feet apart <br />along the length of the wall. <br />8. Stormwater retention and detention. <br />LDR Section 913.09(13) is hereby amended, to read as follows: <br />(13) Stormwater and floodwater systems. A stormwater management system or, if applicable, <br />a floodwater protection stormwater management system,. shall be constructed in <br />accordance with the requirements of Chapter 930. Stormwater shall be retained in a <br />lake for all subdivisions and planned developments except as allowed below. <br />Drainage swales shall be permitted only for conveyance purposes and shall not for <br />count toward meeting capacity requirements. Dry detention may be used only in <br />circumstances where retention in a lake would conflicts with the county's aquifer <br />recharge policies or with preservation of trees and vegetation. In addition, dry <br />detention may be used if warranted by soils or other site characteristics if approved <br />in writing by the Public Works director in accordance with Chapter 930 provisions <br />and regulations. <br />9. Special setback and buffers for active recreation uses. <br />LDR Section 913.09(20) is hereby amended, to read as follows: <br />(20) Recreation tracts; location and restrictions. Recreation tracts shall be located, designed, <br />constructed, maintained, and operated in such a manner that minimizes adverse noise and <br />lighting impacts on adjacent or nearby residential development. <br />(A) Recreation tracts located within one hundred twenty-five (125) feet of the <br />boundary of the subdivision shall either be: <br />1. Designated on the final plat as being used for passive recreation uses: no active <br />uses such as basketball or tennis courts shall be permitted on these tracts; or <br />2. Be buffered from adjacent subdivision boundaries with a minimum twenty-five <br />(25') wide Type "A" or "B" buffer with a six-foot opaque feature (see <br />Chapter 926). <br />(B) Any and all lighting used within recreation tracts shall be approved by the county <br />and shall be adequately shielded to prevent lighting or glare to encroach onto <br />properties adjacent to or nearby the subdivision. <br />10. Common green/recreation space required. <br />LDR Section 913.09(21) is hereby established, to read as follows: <br />(21) Common green space and/or recreation space. All residential subdivisions with a <br />density of more than 1.5 units per acre shall provide in separate tracts a minimum <br />of 7.5% (seven and one-half percent) of the total project site area as common green <br />space and/or recreation space. Upland preserve and wetland areas may be credited <br />towards this requirement.
