IT WAS STATED THAT MR. REMER OWNS THE EASEMENTS, BUT <br />MR. ZORC HAS THE RIGHT FOR INGRESS AND EGRESS. <br />COMMISSIONER SIEBERT QUESTIONED THAT ASSUMING THAT THE <br />RIGHT-OF-WAY DOES END AT MR. REMER'S PROPERTY, THE PROPERTY <br />TO THE NORTH COULD NEVER BE SOLD. <br />COMMISSIONER BOGOSIAN STATED THAT THIS IS A PRIVATE <br />ROAD AND EMERGENCY EQUIPMENT COULD NOT GET THROUGH. <br />ATTORNEY BURCH QUESTIONED THE LEGALITY TO STATE THAT <br />A MAN CANNOT SELL HIS LAND BY METES AND BOUNDS, BUT WE CAN STATE <br />HOW HE CAN DEVELOP IT; IT IS A VALID REGULATION IN THIS COUNTY, <br />THE COUNTY ADMINISTRATOR SUGGESTED THAT THE MINUTES <br />SHOULD SHOW THAT NO BUILDING PERMITS WILL BE ISSUED IN THE <br />NORTH AREA OF TRACK 5, SECTION 11, TOWNSHIP 33 SOUTH, KANDE 39 <br />EAST WITHOUT A SPECIAL EXCEPTION FROM THE BOARD UNLESS SAID <br />TRACT IS SUBDIVIDED IN ACCORDANCE WITH SUBDIVISION REGULATIONS <br />OF THIS COUNTY. <br />ATTORNEY BURCH STATED THAT THE BOARD COULD RECOMMEND THAT <br />THE STATE ATTORNEY'S OFFICE INVESTIGATE INTO THIS TO SEE IF A <br />VIOLATION OF OUR SUBDIVISION REGULATIONS HAS TAKEN PLACE. <br />COMMISSIONER MASSEY CALLED FOR THE MOTION. THE <br />BOARD UNANIMOUSLY APPROVED AND THE MOTION WAS PASSED. <br />A MOTION WAS MADE BY COMMISSIONER MASSEY, SECONDED BY <br />COMMISSIONER DRITENBAS, COMMISSIONER BOGOSIAN VOTED IN OP- <br />POSITION, THE BOARD APPROVED THAT THERE WILL BE NO FURTHER <br />BUILDING PERMITS ISSUED IN THE NORTH HALF OF THE EAST 10 ACRES <br />OF TRACT 5, SECTION 11, TOWNSHIP 3J SOUTH, RANGE 39 EAST, <br />INDIAN RIVER COUNTYkUNLESS SAID TRACT IS SUBDIVIDED IN <br />ACCORDANCE WITH SUBDIVISION REGULATIONS OF THIS COUNTY OR BY <br />SPECIAL EXCEPTION BY THE BOARD OF COUNTY COMMISSIONERS. <br />A MOTION WAS MADE BY COMMISSIONER SIEBERT, SECONDED <br />BY COMMISSIONER DRITENBAS, THE BOARD UNANIMOUSLY APPROVED IN- <br />STRUCTING ATTORNEY BURCH TO POINT OUT TO THE STATE ATTORNEY <br />THAT THERE MIGHT BE A VIOLATION OF°OUR SUBDIVISION REGULATIONS <br />AND ASK FOR HIS INVESTIGATION REGARDING THIS PROBERTY DESCRIBED <br />AS: "THE NE 1/4, LESS THE FORTH 3' THEREOF AND THE WEST 20' <br />OF THE SE 1/4 OF THE S 1/2 OF THE EAST 10 ACRES OF TRACT 5, SECTION <br />11, TOWNSHIP 33 SOUTH, RANGE 39 EAST." <br />-5- <br />eooK 19 PACE 20 <br />
