VAL BRENNAN, PLANNING DIRECTOR, AND ROBERT BERG, ASSISTANT <br />PLANNING DIRECTOR, APPEARED FOR THIS DISCUSSION, AND MR, BERG REPORTED <br />THAT THIS TENTATIVE PLAN'DOES NOT MEET ALL REQUIREMENTS. IT IS THE <br />PLANNING DEPARTMENT'S RECOMMENDATION THAT THIS NOT BE APPROVED BECAUSE <br />THIS PROPERTY IS LOCATED IN A HURRICANE FLOOD ZONE AND IN AN ENVIRON- <br />MENTALLY SENSITIVE AREA. IT DOES NOT CONFORM WITH THE COMPREHENSIVE <br />LAND USE PLAN, <br />THE BOARD DISCUSSED ENVIRONMENTALLY SENSITIVE AREAS IN CON- <br />JUNCTION WITH THE COMPREHENSIVE LAND USE PLAN, AND COMMISSIONER SIEBERT <br />STATED THAT DURING THE PUBLIC HEARING FOR"THE ADOPTION OF THE COMPREHEN- <br />SIVE LAND USE PLAN, IT WAS STATED THAT "ENVIRONMENTALLY SENSITIVE' DID <br />NOT MEAN THAT.NO DEVELOPMENT COULD TAKE PLACE, BUT THAT DEVELOPMENT COULD <br />PROCEED WITH DUE CAUTION, <br />MR, BERG STATED THAT THE PLANNING DEPARTMENT IS NOT SAYING DO <br />NOT DEVELOP, BUT TO FILL IN THIS ENTIRE PARCEL OF LAND IS NOT IN CONFORM- <br />ANCE WITH THE COMPREHENSIVE LAND USE PLAN. WE ARE RAISING A RED FLAG <br />THAT THERE SHOULD BE CONSIDERABLE THOUGHT GIVEN AS TO THE DENSITY IN THAT <br />AREA, MR, BERG CONTINUED THAT HE RECOMMENDS THAT THE COMPREHENSIVE LAND <br />USE PLAN BE CHANGED IF THIS SUBDIVISION IS GRANTED TENTATIVE APPROVAL. <br />MR, VOCELLE STATED THAT IN HIS OPINION IF THE BOARD DENIES <br />TENTATIVE APPROVAL, THEY ARE SAYING THAT.A PERSON CANNOT DEVELOP HIS <br />PROPERTY WITHIN THE ZONING AND YOU ARE TAKING THIS PERSON'S PROPERTY AWAY <br />FROM HIM, HE CONTINUED THAT IF THIS BOARD WAS TO REFUSE TENTATIVE APPROVAL <br />YOU WOULD BE SAYING TO MR. LOWENSTEIN, "You OWN A TRACK OF LAND WHICH IS <br />ZONED FOR THE PURPOSE IT IS INTENDED, BUT YOU CANNOT USE.ITi" <br />JEROME KRAMER, REPRESENTING THE VERO BEACH CIVIC ASSOCIATION, <br />APEEARED.AND STATED THAT THE ASSOCIATION IS NOT TAKING A POSITION ON <br />THE MERITS OF THIS SUBDIVISION, BUT THERE IS A SERIOUS QUESTION DEVELOPING, <br />THIS PROPERTY CONFORMS TO THE EXISTING ZONING, BUT IT DOES NOT CONFORM <br />TO THE COMPREHENSIVE LAND USE PLAN. <br />COMMISSIONER SIEBERT STATED THAT HE AGREED WITH MR. VOCELLE RE <br />THE INDIVIDUAL RIGHTS OF CITIZENS AND, IN HIS OPINION, NOT TO ALLOW THEM <br />TO PROCEED WITH THIS PROJECT COULD RESULT IN CONDEMNATION.
