9. PUBLIC ITEMS
9.A. PUBLICHEARINGS

9.A.1. INDIAN RIVER DRIVE NORTH – PETITION WATER, INDIAN
RIVER COUNTY PROJECT NO. UCP-2632, RESOLUTION III – PUBLIC
HEARING
PROOF OF PUBLICATION OF ADVERTISEMENT FOR HEARING
IS ON FILE IN THE OFFICE OF THE CLERK TO THE BOARD

Dan Chastain, Manager of Assessment Projects, reminded the Board of prior actions on this
matter, recapped his memorandum of September 20, 2006, and asked the Board to approve Resolution
III, which affirms the preliminary assessment roll on the subject property. By way of a slide presentation
he pointed out site locations and noted that questions have arisen regarding the site. He asked the County
Attorney to better explain.

Attorney Collins thought it would be a good idea to hear from residents that might be affected or
benefited by this project. He provided a status report on the matter and recommended that the Board hear
from those who wish to speak on this project but not to approve the resolution confirming it today. He
provided legal opinion to support his recommendation.

Chairman Neuberger asked how long it was anticipated this would take to clear up the
right-of-way problem.

Attorney Collins said it depended on how many property owners were involved in this situation.
He also pointed out that Mr. Barkett’s client seemed willing to negotiate rather than contest this. Mr.
Chastain noted that there probably were about 12 or 13 properties from Roseland Road northward.

The Chairman opened the public hearing.
October 3, 2006
35
