19 <br />ATTORNEY HAS BEEN PAID A BASIC SALARY, INCLUDING ALL FRINGE BENEFITS, AND <br />THERE ARE NO SET HOURS, JOB DESCRIPTION, ETC. HE NOTED THAT PUTTING THE <br />ATTORNEY ON A CONTRACTURAL BASIS WOULD TAKE AWAY ALL OF HIS BENEFITS. <br />ATTORNEY COLLINS STATED THAT HE HAS REALLY APPRECIATED THE <br />BOARD'S ATTITUDE TOWARD THE EMPLOYEE/EMPLOYER RELATIONSHIP, BUT FELT IT IS <br />OF PARAMOUNT IMPORTANCE TO SATISFY THE AUDITOR'S OBJECTIONS WHICH HAVE -s <br />BEEN RAISED ON SEVERAL OCCASIONS. HE, THEREFORE, RECOMMENDED THAT THE <br />BOARD HIRE HIM AS ATTORNEY TO THE BOARD OF COUNTY COMMISSIONERS ON AN <br />INDEPENDENT CONTRACT RELATIONSHIP RATHER THAN ON AN EMPLOYEE/EMPLOYER <br />'BASIS AND SUGGESTED THE BOARD GIVE HIM THE`AUTHORITY TO DELEGATE SOME <br />OF THE FUNCTIONS OF THIS POSITION TO MEMBERS OF HIS FIRM. HE FELT A <br />CONTRACT COULD BE DRAWN IN CONFORMITY TO THE LETTER AGREEMENT DATED <br />JULY 10, 1978, WHICH HE HAD PREVIOUSLY SUBMITTED TO THE BOARD, HE <br />INDICATED THAT HE WOULD BE WELL SATISFIED WITH MAKING THIS CHANGE. <br />CHAIRMAN WODTKE NOTED THAT IF WE ARE GOING TO DO THIS, IT SHOULD <br />BE DONE AS OF JANUARY 1, 1979, <br />COMMISSIONER SIEBERT FELT ON THAT BASIS, THE MOTION SHOULD BE <br />WITHDRAWN AND RESTATED. <br />COMMISSIONER DEESON THEREUPON WITHDREW HIS MOTION AND COMMIS- <br />SIONER LYONS WITHDREW HIS SECOND, <br />COMMISSIONER LOY NOTED THAT THE BOARD FEELS THE AUDITOR'S <br />COMMENTS WERE UNJUSTIFIED, BUT WHEN THE AUDIT BECOMES A PUBLIC DOCUMENT, <br />IT IS OUR ATTORNEY WHO BEARS THE BRUNT OF IT AND NOT THIS BOARD, AND HE <br />HAS NOW INDICATED THAT IT WOULD BE A BETTER PROCEDURE TO GO ON A CONTRACT <br />BASIS. <br />ON MOTION MADE BY COMMISSIONER Loy, SECONDED BY COMMISSIONER <br />SIEBERT, THE BOARD UNANIMOUSLY AGREED TO ENTER INTO A CONTRACT WITH ATTORNEY <br />COLLINS FOR SERVICES TO THIS BOARD IN THE OFFICIAL POSITION OF ATTORNEY <br />TO THE BOARD OF COUNTY COMMISSIONERS, THE CONTRACT TO BE BASED ON HIS <br />LETTER OF JULY 10, 1978 AND TO BECOME EFFECTIVE AS OF JANUARY 1, 1979; <br />AUTHORIZED ATTORNEY COLLINS TO DELEGATE COUNTY FUNCTIONS TO OTHER MEMBERS <br />OF HIS FIRM - COLLINS, BROWN, VAN DE VOORDE, AND EVANS; AND AUTHORIZED <br />THE CHAIRMAN TO SIGN THE CONTRACT. <br />JAN. 10 1979 <br />C+7 <br />s.
