I <br />m <br />COMMISSIONER LOY AGREED,STATING.THAT SHE FEELS -THE BOARD HAS <br />INDICATED,AS STRONGLY AS THEY CAN THAT THEY WOULD NOT FAVOR THROUGH <br />TRAFFIC. <br />COMMISSIONER SIEBERT STATED THAT HE DOES NOT MIND MAKING A <br />COMMITMENT THAT HE HAS NO INTENTION OF OPENING UP 48TH COURT OR BTH <br />PLACE AS THROUGHWAYS. <br />AL GARBUTT OF SUNDOWNER'S TRAIL FELT THE SUBJECT PROPERTY SHOULD <br />BE DEVELOPED INTO R -IE AND THAT IT IS ECONOMICALLY FEASIBLE. <br />STAN OSGOWICZ OF 48TH COURT STATED THAT HE HAS NO OBJECTIONS <br />TO THE LAYOUT PRESENTED TODAY WHERE.THEY SHOW ONE ACRE LOTS ABUTTING <br />MAGNOLIA ESTATES, BUT APPARENTLY THERE IS NO ASSURANCE THIS IS THE WAY <br />IT WILL BE. HE STATED THAT HE WOULD LIKE TO HAVE THE BOARD'S FEELINGS <br />RIGHT NOW ON MAKING 48TH COURT A PRIVATE ROAD. <br />THE BOARD INFORMED HIM THAT THEY WOULD BE HAPPY TO GIVE IT <br />BACK TO THE PROPERTY OWNERS, BUT POINTED OUT FROM THERE ON,* THE PROPERTY <br />OWNERS WOULD BE RESPONSIBLE FOR ITS MAINTENANCE. <br />MR. OSGOWICZ DISCUSSED THE POTENTIAL DRAINAGE PROBLEM, AND MR. <br />BEINDORF INFORMED HIM THAT THE DEVELOPMENT WILL NOT DRAIN TO THE NORTH <br />AND WILL NOT BOTHER - THE PRESENT 30' DITCH. <br />JAMES E. DAVIS OF IDLEWILD DISCUSSED THE ENVIRONMENTAL IMPACT. <br />HE NOTED -THAT THE SEXTON PROPERTY HAS BEEN A GOOD RECHARGE AREA AND <br />DEVELOPING THE TRACT WOULD RESULT IN INCREASED DRAWDOWN OF THE WATER <br />BECAUSE OF ADDED WELLS. HE FELT THIS SHOULD BE CONSIDERED. <br />A. C. PETERSON OF MAGNOLIA ESTATES FELT THE PROPERTY SHOULD <br />BE DEVELOPED IN AS LOW DENSITY AS POSSIBLE, PREFERABLY R -1E. <br />CATHERINE RADABAUGH OF 48TH COURT SPOKE IN FAVOR OF REZONING <br />TO R -IE, CITING TRAFFIC PROBLEMS WITH A HIGHER DENSITY, LESS OPEN SPACE, <br />AFFECT ON PROPERTY VALUES, NOISE POLLUTION, DOGS, ETC. SHE NOTED THAT <br />ATTORNEY JOHNSTON SAID THE VOTE OF THE PLANNING AND ZONING COMMISSION <br />WAS DEADLOCKED, BUT SHE DISAGREED AND STATED THAT IT WAS DENIED. <br />CHAIRMAN WODTKE POINTED OUT THAT THE VOTE WAS 2 TO 2, AND THAT <br />IS A DENIAL. <br />MRS.
