Chairman Wheeler, the Board unanimously approved the <br />Developer's Agreement, authorized the Utilities <br />Department to recover capacity charges and line extension <br />fees from future development, and authorized the Chairman <br />to execute said Agreement, as recommended in the <br />memorandum of January 17, 2007. <br />AGREEMENT IS ON FILE IN THE OFFICE OF CLERK TO THE BOARD <br />11.J.5 GRAND HARBOR SPOONBILL MARSH SITE, AMENDMENT <br />TO GRANT RESTORATION, ACCESS AND RECREATION <br />EASEMENT <br />Director Olson said this was a continuation of what was talked about earlier today. <br />He provided background recapping his memorandum of January 26, 2007. He asked the Board to <br />approve staff's recommendation to approve the agreement in concept until Grand Harbor has <br />signed the Agreement. He also recommended a waiting period of 10-12 days after which he would <br />return to the Board with a report. <br />On Motion by Commissioner Davis, SECONDED by Vice <br />Chair Bowden, the Board unanimously approved the <br />Amendment to the Restoration, Access and Recreation <br />Easement in concept and Director Olson would bring back <br />the signed agreement to the Board in two (2) weeks for the <br />Chairman's signature. <br />February 6, 2007 47 <br />
