SITE PLAN APPROVAL. THE PLANNING & ZONING COMMISSION HAS TAKEN THE <br />REQUESTS SCHEDULED FOR THEIR LAST MEETING AND DEFERRED THEM TO THE <br />MEETING OF .JULY 12TH WAITING FOR THE DRAINAGE STUDY ON WHICH THE <br />-ADMINISTRATOR IS PRESENTLY WORKING. THE CHAIRMAN FELT THE MAJOR INFORMA- <br />TION IN THIS STUDY WILL HAVE TO COME.FROM THE DOT BECAUSE THE MAJOR <br />OUTFALLS ARE DOT OUTFALLS HE CONTINUED THAT HE PERSONALLY DOES NOT <br />LIKE MORATORIUMS, BUT IF THESE SITE PLANS ARE NOT GOING TO BE DISCUSSED, <br />THE PEOPLE SHOULD BE NOTIFIED AHEAD OF TIME. <br />MR. REVER AGREED AND SUGGESTED IF THERE SHOULD BE A MORATORIUM, <br />THAT IT BE SET FOR A SPECIFIC TIME PERIOD. <br />CHAIRMAN WODTKE NOTED THAT FROM A LEGAL STANDPOINT, IF THE <br />SITE PLAN HAS BEEN REQUESTED AND IS IN PROPER FORM, THE PROPERTY OWNERS <br />HAVE A RIGHT FOR IT TO BE ADDRESSED, HE ASKED THE ATTORNEY IF THE <br />PLANNING & ZONING COMMISSION IS IN A POSITION NOT TO ADDRESS THEM, <br />ATTORNEY COLLINS FELT THERE IS A PROBLEM, BUT BELIEVED THAT <br />LEGALLY, EITHER BY AMENDING THE ORDINANCE OR THROUGH A MORATORIUM, THE <br />TIME THAT IS NEEDED TO MAKE THE PROPER STUDY CAN BE PROVIDED. HE <br />CONTINUED THAT IF THE BOARD WERE TO PASS AN ORDINANCE TO EXPAND THE <br />REQUIREMENTS SET OUT UNDER THE SITE PLAN AND REQUIRED AN ENGINEER'S <br />CERTIFICATE AS TO DRAINAGE, ETC., THAT ORDINANCE WOULD BE IN EFFECT AND <br />WOULD BE BINDING ON THE PARTIES. IT COULD,INCLUDE TRAFFIC, AND THEN <br />PEOPLE WOULD HAVE TO PROVIDE THE ZONING BOARD WITH THE NECESSARY PERMITS <br />RE DRAINAGE AND STREET PLANS PRIOR TO BEING APPROVED. <br />CHAIRMAN WODTKE ASKED IF THIS WOULD BE AN ECONOMIC HARDSHIP <br />FOR A SMALL BUSINESS OR AN EXPANSION SITUATION, AND ATTORNEY COLLINS <br />NOTED IF.THERE IS A DRAINAGE PROBLEM IN THE AREA, IT IS A PROBLEM COMMON <br />TO ALL. <br />CHAIRMAN WODTKE ASKED THAT SUPPOSE IT ISN'T, AND THE ATTORNEY <br />FELT IN THAT CASE THE ENGINEER I•S IN A POSITION TO MAKE CERTIFICATION <br />WITHOUT DELAY. <br />ANN ROBINSON POINTED OUT THAT EVEN IF AN ENGINEER CAN GO IN <br />AND SOLVE THE DRAINAGE PROBLEM FOR A PARTICULAR SITE, THERE MAY BE OTHER <br />RAMIFICATIONS FOR THE SURROUNDING AREA.
