AUG 2 21979 <br />BOOK 41 PAGE 379 <br />ATTORNEY COLLINS STATED THAT HE HAS DISCUSSED THIS WITH THE <br />ZONING DEPARTMENT AND THEY HAVE REPORTED THAT THEY HAVE PERSONALLY <br />CHECKED THE PROPERTIES, VERIFIED THE OWNERS, KNOW THAT THE STRUCTURES <br />ARE LOCATED ON THE PROPERTY THEY DESCRIBE AND HAVE WRITTEN CONSENTS. <br />HE, THEREFORE, FELT IT IS ALL RIGHT TO PROCEED, BUT EMPHASIZED THAT <br />WE MUST BE POSITIVE THAT THE STRUCTURES ARE ON THE PROPER PROPERTY. <br />COMMISSIONER SIEBERT ASKED ABOUT FURTHER VERIFICATION OF <br />THE LOW INCOME STATUS OF THE PROPERTY OWNERS, AND MR. REGAN STATED <br />THAT THE ZONING INSPECTORS WORKING WITH THESE CASES HAVE ADVISED HIM <br />THAT THEY ARE LOW INCOME AND THIS ALSO HAS BEEN VERIFIED BY MRS. <br />HABBAKUK WHITFIELD OF THE WABASSO CIVIC LEAGUE, WHO IS VERY KNOWL- <br />EDGABLE OF THE COMMUNITY. <br />VICE CHAIRMAN LOY BROUGHT UP THE MATTER OF ANY MORTGAGES OR <br />LIENS AGAINST THIS PROPERTY. <br />ZONING DIRECTOR WALKER FELT THERE WERE NO MORTGAGES OR LIENS, <br />BUT STATED THAT THERE ARE LAWSUITS. HE STATED THAT THE LAWYERS WERE <br />CONTACTED, AND THEY INSTRUCTED THAT THE COUNTY SHOULD REMOVE THE <br />STRUCTURES AT NO COST TO THE OWNERS. <br />ATTORNEY COLLINS INSTRUCTED THE ZONING DIRECTOR TO GET A <br />LETTER FROM THE ATTORNEYS INVOLVED AUTHORIZING THE REMOVAL OF THE <br />STRUCTURES. <br />MR. REGAN INFORMED THE BOARD THAT TWO OF THESE STRUCTURES <br />ARE BURNED OUT, AND HE FELT THE OTHERS ARE SUCH THAT THEY WOULD NOT <br />BE MORTGAGEABLE. <br />ATTORNEY COLLINS NOTED THAT OUR CONCERN IS THAT THE COUNTY <br />BE HELD HARMLESS FOR THE DEMOLITION. <br />COMMISSIONER LYONS WITHDREW HIS MOTION FOR PURPOSES OF RE- <br />WORDING, AND COMMISSIONER SIEBERT WITHDREW HIS SECOND, <br />MOTION WAS MADE BY COMMISSIONER LYONS, SECONDED BY COMMIS - <br />SIGNER SIEBERT TO APPROVE CLEARANCE AND DEMOLITION UNDER THE COMMUNITY <br />DEVELOPMENT PROGRAM OF THE STRUCTURES LOCATED ON THE FOLLOWING DE- <br />SCRIBED PROPERTIES, SUBJECT TO LETTERS BEING RECEIVED FROM ATTORNEYS <br />REPRESENTING ANY OF SAID PROPERTY OWNERS STATING THAT THEY HAVE NO <br />OBJECTION TO SUCH REMOVAL AND THAT THE COUNTY WILL BE HELD HARMLESS: <br />VIOLA R. CLARK AND ANNIE LYNCH (29-31-39-0000-5000-00014.0) <br />
