FEB2 0190 42 <br />BEEN POSTED WITH THE COUNTY FOR THE WATER, AND THAT AN ADDITIONAL <br />$5,000 CASH BOND WILL BE POSTED TO COVER THE BACK -FILLING OF THE <br />WATER LINE TRENCHES, THE GRADING, AND THE SEEDING OF THE SWALE <br />DITCHES. <br />ADMINISTRATOR JENNINGS RECOMMENDED THE APPROVAL SUBJECT <br />TO RECEIPT OF THE $5,000 BOND, AND ASSISTANT ADMINISTRATOR NELSON <br />CONCURRED WITH THE RECOMMENDATION. <br />DISCUSSION FOLLOWED REGARDING THE WATER PLANT AND IT WAS <br />NOTED THAT THE PLANT WILL SERVICE THE OTHER MITCHELL SUBDIVISIONS. <br />ATTORNEY COLLINS ASKED IF THERE HAD BEEN ANY ATTEMPT FOR <br />MR. MITCHELL TO CONVEY THE WATER LINES TO THE COUNTY AS REQUESTED, <br />AND MR. SCHMUCKER ADVISED HE DID NOT KNOW. <br />THE ATTORNEY EXPRESSED CONCERN ABOUT MR. MITCHELL AND THE <br />FRANCHISE AS HIS EXPERIENCE WITH THE MAN IS THAT MR. MITCHELL DOES NOT <br />DO ANYTHING UNLESS PUSHED INTO IT. ATTORNEY COLLINS STRESSED THAT <br />HE WOULD WANT THE COUNTY TO BE ASSURED THAT MR. MITCHELL WILL DO THE <br />THINGS HE IS SUPPOSED TO HAVE ALREADY DONE, PRIOR TO EXPANDING UPON <br />AN EXISTING PROBLEM. <br />COMMISSIONER LYONS INTERJECTED THAT THE MATTER SHOULD BE <br />HELD UP UNTIL LATER IN THE DAY. <br />MR. SCHMUCKER EXPLAINED TO THE BOARD THAT IT IS IMPORTANT <br />FOR MR. MITCHELL TO RECORD THE PLAT IN ORDER TO HAVE A CLOSING AND <br />OBTAIN SOME MONEY, AS IT IS A REAL PROBLEM TO GET MONEY COMING INTO <br />A PROJECT. HE THEN ADVISED THAT MR. MITCHELL STATED THAT ATTORNEY <br />HENDERSON OR ATTORNEY BLOCK WOULD VERIFY THAT THE WATER LINES WILL <br />BE DEDICATED TO THE COUNTY, IF THAT IS WHAT IS IN THE FRANCHISE <br />AGREEMENT. <br />COMMISSIONER LYONS ASKED WHAT TYPE OF AN AGREEMENT WOULD <br />BE NECESSARY TO MEET THE TERMS OF THE FRANCHISE, AND ATTORNEY COLLINS <br />ADVISED A BILL OF SALE WOULD BE SUFFICIENT. <br />COMMISSIONER LYONS NOTED THAT IF THE OWNER WANTS TO COMPLY, <br />HE SHOULD GET WITH ATTORNEY HENDERSON AND BRING THE BOARD SUCH A <br />DOCUMENT, AND SUGGESTED THE BOARD CONTINUE THIS UNTIL THE AFTERNOON. <br />
