Chairman Wheeler said the ILA would continue if both parties continue to negotiate. <br />Lengthy discussion ensued between Chairman Wheeler and Commissioner Davis. Attorney <br />Collins explained why we would have 100% success in court if we challenged the 4,000 <br />annexations. Commissioner Davis was not willing to spend taxpayers' money to sue taxpayers <br />over something they could otherwise resolve. <br />Commissioner Davis had many questions for the City of Fellsmere: (1) where were <br />they going to put densities; (2) how many densities would be put in; (3) where would they have an <br />opportunity for economic development; (4) where was their requirement for open space in a <br />comprehensive plan going to be; and (5) what was the community going to look like. He was not <br />in favor of suing the City of Fellsmere. <br />Chairman Wheeler asked Commissioner Davis where he would draw the line if he <br />were not in favor of challenging an 18,000 -acre annexation. <br />Vice Chair Bowden did not want to send a message that "we will see you in court." <br />She believed our goal in this County is to preserve our natural beauty and quality of life for the <br />future. She also believed that progress should not destroy, but enhance our quality of life. She felt <br />the Board should make a sincere effort to negotiate with Fellsmere, and not through fear or <br />heavy-handedness. <br />Chairman Wheeler asked Commissioner Davis to explain what bargaining chip we <br />had to offer to Fellsmere to have them take this annexation off the table. Commissioner Davis <br />believed we could negotiate in "good faith", and to take Fellsmere to court would only "poison the <br />well and Fellsmere would win." <br />Fellsmere's City Manager Jason Nunemaker responded to questions from <br />Commissioner Davis. <br />July 10, 2007 39 <br />
