Mr. Paladin, rationalizing the philosophy of doing something drastic, like not <br />having impact fees charged on commercial/industrial development for a moratorium period, <br />asked who would the County be worried about defending itself against, and Administrator Baird <br />said potentially we could have a residential builder sue us. <br />Mr. Paladin in conclusion stated that if we create an incentive even if it is through <br />a temporary moratorium period to give people that incentive, people would not pull permits right <br />away. It was his opinion that it was not a big threat for us to worry about someone suing us. <br />Administrator Baird said we could finance the impact fees and that would be a way <br />of deferring them for commercial only, and that has risks. Discussion continued regarding who <br />would sue the County and whether it would be a good idea to reduce impact fees. <br />The Chairman called a break at 3:21 p.m., and reconvened the meeting at 3:33 <br />p.m., with all members present. <br />Richard Bialosky proposed that the Board consider the suggested one-year <br />moratorium on fees for commercial development; however, because things are so bad right now <br />he was not sure that a blanket moratorium on impact fees would have a beneficial impact. He <br />supported having an across the board moratorium and for the Board to come back and discuss it <br />after a year. He agreed with Commissioner O'Bryan that if we can get people to start buying <br />from our local suppliers, we could turn things around, and that we have to do something to be <br />sustainable here. <br />Don Wright, Sebastian, who has served on the Impact Fee Committee, <br />complimented Board members on their level of understanding and knowledge of impact fees. <br />He felt there were good points made today that needed to be taken into consideration.
