Siebert, Jr., Chairman <br />Board of County Commissioners <br />Indian River County <br />Vero Beach, Fl 32960 <br />Dear Mr. Siebert: <br />In October 1979, I appeared before the county commission <br />concerning my letter of September 12, 1979, regarding <br />drainage problem and Haeger Highland Subdivision. At the <br />board meeting, the decision was for the county to pursue <br />this matter, as the county attorney stated it should be <br />the countyts responsibility to see that this problem was <br />resolved. <br />However Mr. Jack Jennir{gs felt this was not the responsi- <br />bility of the county. I met with Mr. Jennings and he <br />related the county had no responsibility in this matter. <br />Later I learned that the county did indeed require the <br />developer to construct a road and cut ditches. The ditch <br />on the east side of Haeger Highlands Subdivision was never <br />cut to Citrus Road as reauired. This impaired the normal <br />flow to the west and as the side ditches were cut draining <br />the eastern half of the subdivision to the east, to the <br />area where the designed ditch would carry the water north <br />to Citrus Road. With the ditch construction being totally <br />ignored and subsequently approved by the county, the water <br />from this subdivision now flows onto my property, as related <br />in my letter of last year. <br />I consider this drainage of water onto my property extremely <br />damaging, as well as creating a tremendous health hazard. <br />I consider the county responsible for allowing this to happen. <br />I would appreciate your examining this situation and taking <br />immediate action to correct this inadequate drainage provision. <br />Yours t.r y, <br />Ray Prescott <br />255 9th Court <br />Vero Beach, F1 32960 <br />CHAIRMAN SIEBERT INFORMED THE BOARD THAT HE HAS <br />DISCUSSED THIS MATTER WITH MR. PRESCOTT AND HAS INFORMED MR. PRESCOTT <br />THAT THE ATTORNEY HAS STATED THE COUNTY HAS NO OBLIGATION IN THIS <br />MATTER, AND FURTHER THAT TWO SIMILAR REQUESTS MADE WHERE DRAINAGE <br />WAS NOT PUT IN PRIVATE SUBDIVISIONS ACCORDING TO THE PLAT WERE DENIED. <br />EON <br />OCT 2 219 80 <br />wx 45 $7 <br />
