2. Notwithstanding these limitations, an applicant may <br />intentionally phase a project with specific <br />development timeframes. Development phasing may <br />not cover a period exceeding 20 years. <br />Commencement of construction must begin within 30 <br />months of completion and inspection of the previous <br />phase. Preliminary plat approval will lapse if the <br />approved phase timeframes are exceeded, unless <br />otherwise extended by the board of county <br />commissioners as provided for in section <br />913.07(4)(K). <br />(K) Extensions. A request for an extension of preliminary <br />plat approval may be submitted to the community <br />development department any time prior to expiration of <br />the preliminary plat. No request for extension of <br />preliminary plat approval will be accepted after the <br />preliminary plat approval has lapsed or phasing schedule <br />exceeded. The applicant may, however, reapply for <br />preliminary plat approval under the then -existing <br />provisions of this chapter and the other land <br />development regulations; a new filing fee will be <br />required, as well as review and approval under then - <br />existing procedures. <br />1. Extension requests shall be accompanied by a <br />completed extension request form, furnished by the <br />planning division. <br />2. The planning division shall schedule the request <br />for TRC consideration and shall route the request <br />information to the reviewing departments and <br />agencies in a manner similar to preliminary plat <br />applications. TRC comments, if any, shall be <br />forwarded to the applicant for an adequate <br />response. <br />3. Upon receiving a response from the applicant and <br />after review of the response by the TRC members, <br />the planning division shall forward the TRC <br />recommendation(s) to the Board of County <br />Commissioners. The Board of County Commissioners <br />decision shall be final. <br />(L) Transfer of Approval. Prior to final plat approval, a <br />notice of transfer of property and of preliminary plat <br />approval must be filed with the community development <br />department prior to transfer in bulk of the proposed <br />subdivision. The plat shall note the following: "Prior <br />to transfer, the transferee must assume in writing on a <br />form, acceptable to the county attorney, all <br />commitments, responsibilities, and obligations of the <br />prior developer. Failure to give timely notice or to <br />provide the assumption of prior commitment voids the <br />preliminary approval". <br />291 <br />
