MOTION WAS MADE BY COMMISSIONER SCURLOCK, SECONDED BY <br />COMMISSIONER BIRD THAT A WEIR BE INCLUDED IN THE CONSTRUCTION OF THE <br />CULVERT. <br />THE CHAIRMAN CALLED FOR THE QUESTION. IT WAS VOTED ON <br />AND CARRIED WITH A VOTE OF 3 TO 1, WITH COMMISSIONER FLETCHER VOTING <br />} <br />IN OPPOSITION, AND COMMISSIONER WODTKE BEING ABSENT. <br />CHARLES SULLIVAN NEXT CAME BEFORE THE BOARD AND EXPLAINED <br />THAT HE AND HIS WIFE OWN ONE ACRE IN THE FILLED AREA AND EXPRESSED <br />CONCERN WITH THE LOCATION OF THE RIGHT-OF-WAY. HE FELT THAT THEY <br />WOULD BE CONDEMNING LAND THAT IS SO VALUABLE THAT THE RIGHT-OF-WAY <br />COST COULD .BE TREMENDOUS. MR. SULLIVAN STATED THAT THE MINUTE <br />THEY COME TO COUNTRY CLUB POINTE THEY MAKE A JOG TO THE CITY LIMIT <br />LINE, COMPLETELY TERMINATING ANY DEVELOPMENT BETWEEN THE WESTERN <br />RIGHT-OF-WAY BOUNDARY OF THIS HIGHWAY, AND THE CITY LIMIT LINE. <br />HE FELT THE LOCATION SHOULD BE MOVED JUST A FEW FEET TO THE EAST AND <br />THEY WOULD HAVE ALL THE LAND THERE FOR DEVELOPMENT TO BE A TAX BASE, <br />AND THE RIGHT-OF-WAY COST WOULD BE LESS. MR. SULLIVAN ADVISED THAT <br />HE WOULD BE HAPPY TO DONATE THE PORTION OF HIS LAND NEEDED FOR THIS. <br />HE ADDED THAT HE WOULD LIKE TO BE ABLE TO DISCUSS THIS FURTHER NOW <br />OR AT SOME MEETING THAT WAS MORE APPROPRIATE. <br />CHAIRMAN LYONS COMMENTED THAT THE FIRST MISTAKE WAS MADE <br />WHEN THEY PUT THE HOSPITAL WHERE IT IS NOW - THEN IT WAS LIKE A R -OW <br />OF DOMINOS. HE CONTINUED THAT THE ONLY WAY WE CAN GET A ROAD THROUGH <br />THERE WAS TO USE AN ALIGNMENT AS FAR WEST AS POSSIBLE. THIS IS A <br />PROBLEM THEY HAVE BEEN FIGHTING FOR YEARS, THE CHAIRMAN STATED. <br />HE THOUGHT IT VERY UNLIKELY THAT THEY COULD GET A PERMIT IF THE <br />i <br />ROAD IS MOVED ANY MORE TO THE EAST. <br />ATTORNEY RALPH EVANS, ASSOCIATED WITH ATTORNEY COLLINS' <br />FIRM, COMMENTED THAT THE NEXT STEP IN THE PROCESS WOULD BE TO ADOPT <br />THE RIGHT-OF-WAY MAPS AND RESOLVE TO PROCEED WITH THE CONDEMNATION. <br />HE CONTINUED THAT THE COUNTY MUST PROVE, IN THE JUDICIAL PROCESS, <br />IF THERE IS A NECESSITY FOR THIS ROAD. <br />
