will take some or all of the following actions at no additional cost to the Owner, <br />submitting to the Engineer for approval, a written statement of the steps he intends <br />to take to remove or arrest the delay to the critical path in the approved schedule. <br />1. Increased construction manpower in such quantities and crafts as will <br />substantially eliminate, in the judgment of the Engineer, the backlog of Work. <br />2. Increase the number of working hours per shift, shifts per working days per <br />week, the amount of construction equipment, or any combination of the <br />foregoing, sufficiently to substantially eliminate. in the judgment of the Engineer, <br />the backlog of work. <br />3. Reschedule activities to achieve maximum practical concurrency of <br />accomplishment of activities, and comply with the revised schedule. <br />4. Costs incurred by the Owner arising from such lengthening of hours, including <br />furnishing of Inspectors, shall be the Contractor's responsibility and shall be <br />deducted from monies due him. Failure of the Contractor to comply with the <br />requirements of the Engineer may be grounds for determination by the Owner <br />that the Contractor is not proceeding at such rates as will insure completion <br />within the specified time and may result in the termination of the right of the <br />Contractor to continue the Work. <br />3.02 ADJUSTMENT OF CONTRACT SCHEDULE AND COMPLETION TIME <br />A. If the Contractor desires to make changes in his method of operating which affect <br />the approved schedule, he shall notify the Engineer in writing stating what changes <br />are proposed and the reason for the change. If the Engineer approves these <br />changes, tha Contractor shall revise and submit for approval. without additional <br />cost to the Owner, all of the affected portion of the schedule. The schedule shall be <br />adjusted by the Contractor only after prior approval of his proposed changes by the <br />Engineer. <br />B. Adjustments may consist of changing portions of the activity sequence and/or <br />activity durations, division of approved activities, or other adjustments as may be <br />approved by the Engineer. The addition of extraneous, non -working activities <br />and/or activities which add unapproved restraints to the schedule shall not be <br />approved. <br />C. If the completion of any activity, whether or not critical, falls more than 100 percent <br />behind its approved duration, the Contractor shall submit for approval a schedule <br />adjustment showing each such activity divided into two activities reflecting <br />completed versus uncompleted work. <br />D. Shop drawings which are not approved on the first submittal or within the <br />scheduled time shall be immediately rescheduled.. as well as pipelines and tanks <br />which do not pass leak tests. <br />E. The contract completion time will be adjusted only for causes specified in this <br />contract. In the event the Contractor requests an extension of any contract <br />completion date, he shall furnish such justification and supporting evidence as the <br />Engineer may deem necessary for determination as to whether the Contractor is <br />entitled to an extension of time under the provisions of the contract. Engineer will, <br />after receipt of such justification and supporting evidence make findings of fact and <br />will advise the Contractor in writing thereof.
