Griffith request to rezone <br />two parcels from C-1, Commercial to R-1, <br />Single Family Residential <br />FROM: Neil Nelson REFERENCES: <br />County Administrator <br />It is recommended that the data herein presented be given formal consideration by the <br />Board of County Commissioners in the form of a public hearing on January 20, 1982: <br />DESCRIPTION AND CONDITIONS <br />The applicant is requesting that two parcels of land currently zoned C-1, Commercial <br />be rezoned to R-1, Single Family Residential (6 units/acre). The subject properties <br />include: Lot 6 and a portion of Lot 7 (approximately .4 acres); and Lot 8 and a portion <br />of Lot 10 (approximately .25 acres) of Karr Subdivision which is located west of River- <br />side Drive, north of Sebastian. <br />The Comprehensive Plan designates the property and surrounding area as MD -1 (up to 8 <br />units/acre) and 40 acre commercial node is situated to the south. <br />ALTERNATIVES AND ANALYSIS <br />A) 1. Approve the request to rezone both parcels from C-1, Commercial to R-1, Single <br />Family Residential (6 units/acre). <br />This would allow single family homes to be developed on the two lots. The <br />result would be an upgrading of the existing situation in which most of the <br />lots in Karr Subdivision are occupied by mobile homes. Commercial development <br />of the subject properties is not appropriate or compatible with the existing <br />land use in the area. <br />2. County Commission initiation of a rezoning of the remainder of Karr Subdivision <br />which is currently zoned C-2, Commercial to R-1, Single Family Residential (6 <br />units/acre). <br />Lot 9 and a portion of Lot 10 of Karr Subdivision is presently zoned R-1, Single <br />Family Residential and would not need to be included in the rezoning action. <br />The subject properties are currently vacant. Single family and mobile homes, <br />which are non -conforming uses, are situated on the remaining lots within the <br />subdivision. <br />Rezoning of the Karr Subdivision would not eliminate most of the non- <br />conforming uses because mobile homes are not allowed in R-1, Single <br />Family Residential Districts. However, the commercial zoning is not <br />appropriate for the predominately residential area. A majority of the <br />approximately 9 acre commercial district to the south of the subdivision <br />fs vacant. This commercial district provides land for any future commercial <br />development which is likely to occur in the area. <br />B. Deny the request to rezone the subject properties from C-1, Commercial to R-1, <br />Single Family Residential (6 units/acre). <br />Under this alternative the properties would remain commercial and are likely <br />to remain undeveloped because of the incompatibility with the existing <br />residential development in the area. <br />RECOhFIENDAT ION <br />The staff recommends that the subject properties, as well as the entire Karr Sub- <br />division, be rezoned from C-1, Commercial to R-1, Single Family Residential as out- <br />lined in Alternative A. This would result in an eventual upgrading of the area as <br />other lots were developed with single family homes. <br />The Planning and Zoning Commission unanimously approved this recommendation in the <br />public hearing of December 3, 1981. This recommendation is consistent with the - <br />adopt*M rehensive Plan. <br />53 <br />
