Staff's review and analysis of available information discloses no adverse <br />comments from local governments utilizing their service regarding types, quan- <br />tity and quality of service. <br />Staff offers the following alternatives: <br />A. Approve, subject to renegotiation, the franchise transfer to <br />Waste Management of Florida, Inc. <br />The advantage of this alternative is to enable staff to re- <br />negotiate an agreement of shorter duration and provide for <br />franchise fees. <br />The disadvantage is the elimination of competition. <br />B. Approve the franchise transfer to Waste Management of Florida, <br />Inc. <br />The advantage is it would be easy to accomplish. <br />The disadvantages of transferring the franchise are that the <br />county is not given the opportunity to (1) reduce the extremely <br />long (30 years) period of the agreement, (2) provide for fran- <br />chise fees to be paid to the county, and (3) solicit competitive <br />bids. <br />The Indian River Sanitation Service franchise was granted October 3, 1975 <br />for thirty (30) years expiring October 3, 2005. The sales agreermnt requires <br />approval of this transfer before February 28, 1982. <br />RECOMMEiNIDATIONS & FUNDING <br />Due to the deadline for approval of this franchise transfer, the receipt of <br />all data requested, and the favorable results of our contacts with local govern- <br />ments utilizing the services of Waste Management of Florida, Inc. Staff recom- <br />mends approval of the franchise transfer, conditioned upon negotiation/renegotia- <br />tion of an agreement acceptable to the County within 120 days. The renegotiation <br />would upgrade the terms; modernize the language; provide a formula for payment of <br />franchise fees to the County; and review the appropriate expiration date of the <br />franchise. <br />FEB <br />Administrator Nelson stated that a great deal of <br />time was spent gathering this information; they have been <br />sending out questionnaires and have had favorable input. <br />The Administrator continued that based on this, they have <br />scrutinized the material and recommend approval of this <br />transfer, conditioned upon negotiation on the agreement <br />within 120 days. Mr. Nelson felt the language in the <br />agreement could be modernized. <br />Commissioner Fletcher stated that this was <br />probably the finest piece of work that he had seen from the <br />Administrator and Counsel; and they have his thanks. <br />29 <br />k o 48 PAsE 794 <br />A <br />
